TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated May 18, 2018, and duly recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed of Trust Book 429, at Page 842, Jeffrey D.A. Robertson, Sr. did convey unto Mary E. Page, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Morgan County Courthouse, in Berkeley Springs, West Virginia, on
September 4, 2024, at 1:30 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Cacapon District, Morgan County, West Virginia, and more particularly described as follows:
Lot No. Eight A (8A), containing 10.00 acres, more or less, of Section I of Cold Spring Forest, as appearing on a plat prepared by DL Consulting, PLLC, dated September 28, 2007, and of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book No. 227 at Page 432, to which reference is made for all pertinent and proper reasons, including a more particular metes and bounds description of said real estate.
This Grant is made subject to public utility easements of record.
This Grant is further made subject to and together with all those rights, reservations, restrictions, covenants, conditions, liens, assessments, easements, and rights-of-way contained and set forth in that certain Declaration, dated September 12, 1989, and recorded in said Clerk’s Office in Deed Book 152 at Page 862.
Said real estate is depicted on the 2017 Morgan County Land Books as District 04, Tax Map 27, Parcel 13.1.
And being the same real estate which was conveyed unto Jeffrey D.A. Robertson, Sr., and by deed of Charles C. Stone and Virginia L. Stone, dated April 30, 2018, and to be recorded prior to or contemporaneously with the recordation of this instrument in the Office of the Clerk of the County Commission of Hampshire County, West Virginia.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 132 Candlewood Lane, Great Cacapon, WV 25422.
AND BEING the same real estate which was conveyed to Jeffrey D.A. Robertson, Sr., by Deed dated April 30, 2018, from Charles C. Stone and Virginia L. Stone, and recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 266, at Page 314.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
