TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 16, 2020, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5072, at Page 6042, Tyler W. Thompson did convey unto Gavin Ward, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:

The following tract or parcel of land, lying south of or near Millers Creek in Trap Hill District, Raleigh County, West Virginia, and more particularly bounded and described as follows:

Beginning at an iron rail at an existing fence corner, common corner to Crab Orchard Land and Coal Company, Crab Orchard Improvement Company and the property herein described, said common corner being described as part of the first tract as described in a deed from Frank Raso II and Jo Ann Raso, his wife, to Leno and Peggy Raso, as recorded in Deed Book 449, page 135, in Raleigh County Clerk’s Office, Raleigh County, West Virginia; thence with an existing fence line on the southernmost boundary line of Section 6, Lang Avenue (with dead end side) and Section 7 of the Harper Addition as shown on a map by Wilson and Phelps, dated July 5, 1934, recorded in Map Book 7, page 10, in the Raleigh County Clerk’s Office, Raleigh County, West Virginia, S 40° 42’ 34” E 764.40 feet to a fence post, common corner to Eugene Congemi and Lot No. 41, Section 7, as shown on aforementioned map; thence with the boundary line of Lots No. 27, 28, 29, 30, 31, 32 and 33, Section 7 of the Harper Addition as shown on a map by Wilson and Phelps, July 5, 1934 and recorded in Map Book 7, page 10, of the Raleigh County Clerk’s Office, S 33° 12’ 05” W 139.26 feet to a corner post, common corner to Glenna Barker property and the property herein described and with an existing fence line S 46° 05’ 00” E 55.00 feet to a point in the aforesaid common boundary line of Glenna Barker and the property herein described; thence leaving the common line heretofore mentioned and with a new line S 40° 11’ 31” W 133.71 feet to a point in the common boundary line between Fred Hodges and the property herein described, being a part of the fourth tract, described in a deed from Frank Raso II and Jo Ann Raso, his wife, to Leno and Peggy Raso, recorded in Deed Book No. 449, page 135, Raleigh County Clerk’s Office, Raleigh County, West Virginia; thence with the common boundary line between Fred Hodges and the property herein described N 44° 03’ 24” W 53.00 feet to a common corner of Fred Hodges and the property herein described, thence continuing with the aforementioned common boundary line S 43° 46’ 29” W 38.50 feet to a corner post in an existing fence line between the property herein described and Sam Congemi, et al tract; thence leaving the aforementioned common boundary line between Fred Hodges and the tract herein described N 42° 46’ 25” W 245.33 feet to an iron rail in an existing fence line between the property herein described, and Sam Congemi, et al tract and Lot No. 5, Section 8, of the Harper Addition as shown on a map by Wilson and Phelps dated July 5, 1934, recorded in Map Book 7, page 10, in the Raleigh County Clerk’s Office, Raleigh County, West Virginia; thence with the existing fence line S 53° 17’ 00” W 79.94 feet to a fence corner post; thence leaving Lot No. 5, Section 8 and with an existing fence line N 31° 05’ 47” W 427.23 feet to a fence corner post on the common boundary line of the Crab Orchard Coal and Land Company and the property herein described; thence with an existing fence line and the aforementioned common boundary line N 23° 04’ 18” E 356.25 feet to the point of beginning and containing 5.82 acres, more or less, and being a part of the same property conveyed to Frank Raso by Joseph Luchini, Trustee, by deed dated March 14, 1995, and recorded in the Office of the County Clerk of Raleigh County, West Virginia in Deed Book 344, at page 217, and as shown upon a map dated August 1968 attached hereto and made a part hereof.

The grantors also convey unto the granted an easement for the use of a stairway leading from the property to be conveyed to Route No. 3 as shown upon the aforesaid map and marked thereon “Easement to Existing Stairway”.

There EXCEPTED and RESERVED from the above tract is that certain parcel of land conveyed to Frederick Ackley Alexander, Jr. and Frances Sluss Alexander by Harry McGraw, Deed dated February 20, 2009 and recorded in Deed Book 5034, Page 6538, being more particularly described as follows:

Beginning at a rebar (set), being a common corner of the Harry James McGraw (now Adams) tract of land and the Glenna Barker tract of land, thence leaving Barker and with the boundary line of the Harry James McGraw (now Adams) parcel of land, containing 0.836 acres; N. 42° 03’ 12” 129.10’ to a point at a 30’ Ingress/Egress Access Easement; thence leaving said Harry James McGraw (now Adams) parcel of land (containing 0.836 acres) with the line of the 30’ Ingress/Egress Access Easement; N 32° 27’ 28” E 147.72’ to a point at a post, being a corner of the Peggy J. Cangemi parcel of land, thence leaving the 30’ Access Easement, and with the boundary line of the Cangemi parcel of land; S 39° 20’ 28” E 137.99 feet to a point, being a common corner of said Cangemi parcel, at the boundary line of said Glenna Barker parcel; thence leaving said Cangemi parcel and with the boundary line of said Barker parcel of land; S 35° 12’ 05” W 139.26’ to the point of beginning, containing 0.424 acres, more or less.

ALSO EXCEPTED and RESERVED from the above tract is that certain parcel of land conveyed to Adam Q. Farley and Mary L. Farley by Harry McGraw, Deed dated August 5, 2006 and recorded in Deed Book 5018, Page 8601, being more particularly described as follows:

Beginning at a T/rail (found), being a corner of the said McGraw tract of land and the Fred Hodges, Jr. and Irene Hodges (573-571), parcel of land at the boundary line of the Eddie L. & Kathryn Hampton (MR48-PG1902), parcel of land, thence with the boundary line of the said Hampton parcel of land,; N 42° 46’ 25” W 200.00’ to a rebar (set), a new corner, thence leaving the boundary line of the said Hampton parcel of land and with two (2) new lines through the Harry James McGraw (MR 97-PG1435), tract of land; N 55° 25’ 33” E 167.58’ to a painted rock, a new corner, thence; S 42° 03’ 12” E 160.23’ to a rebar (set), being a corner of the Glenna Barker (490-318), parcel of land, thence with the boundary line of the said Barker parcel of land; S 46° 05’ 00” E 50.95’ to a rebar (set), being a corner of the Jewel Hales (654-572), parcel of land, thence with the boundary line of the said Hales parcel of land; S 40° 11’ 31” W 128.14’ to a rebar (set), a corner of the said Hales parcel of land at the boundary line of the said Hodges (573-571), parcel of land, thence with the boundary line of the said Hodges parcel of land, two (2) courses and distances; N 44° 03’ 24” W 53.00’ to a rebar (set), thence; S 43° 46’ 29” W 38.50’ to the point of beginning, containing 0.836 acres, more or less, as surveyed by ESI, Inc., Beckley, West Virginia.

And being the same property conveyed to Tyler W. Thompson by Deed dated the 16th day of October, 2020 from Harry J. McGraw, prior to or simultaneously herewith.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 210 Ennic Road, Eccles, WV 25836.

AND BEING the same real estate which was conveyed to Tyler W. Thompson, by Deed dated October 16, 2020, from Harry James McGraw, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5072 at Page 6041.

The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
