General Notice
The Tomlinson Public Service District (Owner) is requesting Bids for the construction of the following Project:
Water System Improvements
Contracts 1 and 2
Bids for the construction of the Project will be received at the Tomlinson PSD office located at 2830 Sixth Street, New Cumberland, West Virginia 26047, October 4th, 2024 , at 11:00 am local time for Contract 1, and at 11:30 am local time for Contract 2. At those times, the Bids received will be publicly opened and read.
The Project includes the following Work:
Contract 1 – Newell Water Treatment Plant
This project includes construction of a new 1,200 GPM water treatment plant consisting of: improvements to the existing Raw Water Well pump discharge piping; 174,900 gallon Raw Water Buffer Tank; 4,320 SF concrete masonry unit treatment building; pressure filtration treatment system featuring four (4) 10′-0″ diameter tanks and two (2) pipe racks; two (2) 1,200 GPM filter feed pumps; two (2) 1,200 GPM high service pumps; 45,150 gallon cast-in-pace concrete, below ground Clearwell; chemical feed equipment; 23,697 gallon backwash water waste tank and pump station; plant piping and valves; office, lab, and bathroom; HVAC; electrical and lighting; emergency generator; SCADA system and instrumentation; site work; excavation and backfill; asphalt paving; perimeter site fence and gates; concrete sidewalks; landscaping; and all other necessary appurtenances for a complete and in-place installation.
Contract 2 – Newell Waterline Replacement
The project includes approximately 6,250 LF of 12″ DIP waterline; 615 LF of 12″ DIP, restrained joint waterline; 4,280 LF of 12″ PVC C900 DR 14 waterline; 610 LF of 12″ PVC C900 Certa-Lok waterline; 50 LF of 10″ PVC C900 DR 14 waterline; 60 LF of 8″ PVC C900 DR 14 waterline; 395 LF of 8″ PVC SDR 35 gravity sewer pipe; 815 LF of 8″ DIP, restrained joint gravity sewer pipe; 170 LF of 24″ steel casing, bore & jack; 75 LF of 24″ steel casing, open cut; 28 EA 12″ gate valves; 6 EA 8″ gate valves; 2 EA air release valve assemblies; 1 EA remove and replace existing fire hydrant assembly: 8 EA cut and cap existing 10″ waterline; 4 EA master meter with vault; 8 EA 4′-0″ diameter precast manholes; 2 EA manhole inside drop connections; 8 VF manhole riser sections; 1 EA connection to existing manhole; 2 EA 8″ x 6″ PVC Wye service connections; 1 EA 8″ x 6″ DIP Wye service connection; 10 LS connections to existing waterline; 1,775 LF of Type ‘A’ trench restoration; 1,825 LF of Type ‘B’ trench restoration; 1,740 LF of Type ‘C’ trench restoration; 2,820 SY of asphalt overlay; 8 LF of sidewalk restoration; 2,500 LF of rip rap ditch repair; 1 LS mobilization; 1 LS pre-construction video; 1 LS erosion and sedimentation control; 4,971 LF of WV DOH Inspection Fees (water); 825 LF of WV DOH Inspection Fees (sewer); and all necessary appurtenances.
Any contract or contracts awarded under this advertisement for bids are expected to be funded in part by grants and loans from: the West Virginia Department of Environmental Protection State Revolving Fund. Neither the United States, the State of West Virginia nor any of their departments, agencies or employees are or will be a party to this invitation to bid or any resulting contract.
No bid may be withdrawn for a period of ninety (90) days after the time of the opening of bids.

Prospective Bidders may obtain the Bidding Documents at the Issuing Office (the office of Ghosh Engineers, Inc.) on Monday through Friday between the hours of 8:00 am to 4:00 pm. Partial sets of Bidding Documents will not be available from the Issuing Office. Neither Owner nor Engineer will be responsible for full or partial sets of Bidding Documents, including addenda, if any, obtained from sources other than the Issuing Office. All Bidders must be a registered holder of Bidding Documents with the Issuing Office.
Printed copies of the Bidding Documents may be obtained from the Issuing Office by paying a NON-REFUNDABLE payment of $200.00 for Contract 1, and $175.00 for Contract 2. Costs of shipping each request are included in this payment.
Pre-bid Conference
A MANDATORY pre-bid conference for the Project will be held on September 20th, 2024, at 11:00 am local time for both Contracts at the Newell Lions Club, 510 Washington Street, Newell, WV 26050. Bids will not be accepted from Bidders that do not attend the mandatory pre-bid conference.
Bid Security
A certified check made out to the Owner, or a Bid Bond executed by the Bidder and Bidder’s surety company approved by the Owner, in the amount equal to five percent (5%) of the bid, shall be submitted with each bid. No bid shall be waived or returned because the bidder failed to or cannot comply with any requirements as set forth in the Plans, Specifications, or any applicable statues of the United States, the State of West Virginia, and/or local ordinance.
Bidding Method
The Bid package must be submitted in two (2) envelopes for each Contract. The envelopes must contain the following:

Envelope No. 2
a. Bid Form
Contractor’s License
All bidders are required to have a West Virginia Contractor’s License per Section 21-11-11 of the West Virginia Code.
West Virginia Alcohol and Drug Free Workplace Act
West Virginia Code 21-1D-5 provides that any solicitation for a public improvement construction contract requires that each vendor that submits a bid for the work submits at the same time an affidavit of compliance with the bid. The enclosed Drug Free Workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of Article 1D, Chapter 21 of the West Virginia Code. Failure to submit the signed Drug Free Workplace affidavit in the first envelope shall result in disqualification of such bid.
Notice of Federal Wage Rates
Contractors are required to comply with all federal wage rates issued in accordance with the Davis Bacon Act. The contractor will be required to pay the federal wage rates appropriate for each worker classification.
Nondiscrimination In Employment
Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.
Suspension And Debarment
Recipient shall not entertain the use of businesses that are listed on the ‘System for Award Management (SAM)’ at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.
DBE Requirements
Each bidder must fully comply with the Disadvantaged Business Enterprises, and Affirmative Action requirements, as identified in the contract documents.
The Bidder agrees to make “good faith efforts” to subcontract a portion of the total value of the contract to Disadvantaged Business Enterprises. This shall be done in compliance with the six (6) affirmative steps as outlined in 40 CFR 33.240. Failure to demonstrate positive efforts to do so may lead to rejection of bids. For this program, the term “subcontract” includes all construction, service, and modification work contracted for by the bidder in the execution of the work under this contract.
Contractor’s Sales Tax Exemption
The Tomlinson Public Service District is exempt from West Virginia Sales Taxes and, by West Virginia Code Section 11-15-8d, can now extend this tax exemption to Contractors supplying goods on their behalf. The Contractor shall coordinate with the (Town/PSD) the filing of any and all applications to the State of West Virginia, exempting the purchase of the specified Goods from West Virginia Sales Tax and hereby agrees to include the savings from such sales tax exemption in its total base bid.
America Iron and Steel Requirement
P.L. 113-76, Consolidated Appropriations Act, 2014 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.
Time of Completion
The Time of Completion for this Contract shall be 365 consecutive calendar days, for each Contract, beginning with the Award of Contract and written Notice to Proceed. Substantial completion shall be accomplished within 335 calendar days, and ready for final payment within 365 calendar days. Liquidated damages shall be assessed after that at the rate established in the agreement.

For all further requirements regarding bid submittal, qualifications, procedures, and contract award, refer to the Instructions to Bidders that are included in the Bidding Documents.
Bids received after the scheduled closing time for the reception of bids will be returned unopened to the bidders.
The Tomlinson PSD reserves the right to reject all bids.
