TOWN COUNCIL OF THE
TOWN OF SOPHIA, RALEIGH COUNTY, WEST VIRGINIA
NOTICE OF PETITION FOR
ANNEXATION PURSUANT TO WV CODE §8-6-4

Notice is hereby given by the Town of Sophia, West Virginia that it will hold a hearing for public input with regard to a Petition for Annexation pursuant to West Virginia Code §8-6-4 at its own request as the sole property owner (fee holders) and qualified voter within this territory which the Town of Sophia proposes to annex.

The area of land proposed to be annexed consists of three (3) tracts of approximately .96 acres, .444 acres and 6.332 acres owned by the Town of Sophia and more particularly described herein, as well as the appurtenant portions of Hot Coal Road, described on the referenced petition.

TRACT NO. 1:
Beginning at a 5/8” steel rebar (set) on the southern right of line of a stone base road leading to the Town of Sophia Wastewater Treatment Plant, said point being located S. 41 23’ 04” W., and 638.16 feet from a set stone (found) at the eastern corner of the 4.42 Acre Tract conveyed to Appalachian Electric Power Company by deed dated February 7, 1927; thence, following the southern right of way line the following six (6) courses and distances: S. 44 39’ 35” E., 44.29 feet to a point at the beginning of a curve to the right; thence, along a curve to the right with a radius of 294.73 feet and a chord of S. 41 05’ 22” E., for 36.84 feet to a point of tangency; thence, S. 37 02’ 45” E., for 30.30 feet to a point at the beginning of a compound curve to the right; thence, along a curve to the right with a radius of 299.00 feet and a chord of 27 37’ 15” E., for 86.10 feet to the beginning of a curve to the right; thence, along a curve to the right with a radius of 222.00 feet and a chord of S. 19 41’ 30” E., for 55.64 feet to a point of tangency; thence S. 06 16’ 42” E., for 36.15 feet to a point: thence, leaving the southern right of way line of the stone base road and making new lines through Beaver Coal Company’s Tract 27, the following four (4) courses and distances: N. 43 58’ 40” W., for 100.30 feet to a 5/8 inch steel rebar (set); thence S. 46 01’ 20” W.,155.78 feet to a 5/8” steel rebar (set); thence, N.43 58’ 40” W., for 172.80 feet to a 5/8 steel rebar (set); thence, N. 46 01’ 20” E., for 230.00 feet to the point of beginning, containing 0.966 acres, more or less

And being the same property conveyed to Town of Sophia by Beaver Coal Company Limited in that certain deed dated the 31st day of May, 1995 of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Roll 75, at Page 1664.

TRACT NO. 2:
BEGINNING at a 5/8” rebar w/cap (set), being a new corner within Tract No. 27 of the Beaver Coal Company Ltd. (DB 5037 – Pg. 5289) tract, said corner being referenced N. 28° 37’ 29” E. 2729.11’ to a t-rail (found), called for, being a corner to said Tract No. 27, thence with two (2) new lines through said Tract No. 27; S 73° 39’ 42” E 219.09’ to a 5/8” rebar w/cap (set), a new corner, thence; S 19° 50’ 16” W 94.73’ to a 5/8” rebar w/cap (set), a new corner along the northern right of way line of WV Secondary Rte. 29/2, a.k.a. Independence Road, (being a 60’ right of way), thence, with the northern right of way line of said WV Secondary Rte. 29/2 four (4) courses and distances, the first being a curve to the left having a radius of 475.63’, an arc length of 18.17’ and a chord bearing and distance; N 68° 00’ 33” W 18.17’ to a point; thence; N 69° 21; 49” W 97.14’ to a point, thence with a curve to the right having a radius of 650.11’. an arc length of 93.15’ and a chord bearing and distance; N 64° 49 51” W 93.07’ to a point, thence; N 59° 22’ 57” W 35.25’ to a 5/8” rebar w/cap (set), a new corner on the northern right of way line of said WV Secondary Rte. 29/2, thence leaving the northern right of way line of said WV Secondary Rte. 29/2, and with a new line through said Tract No. 27; N 40° 17’ 56” E 68.39’ to the point of BEGINNING, containing 0.444 acres more or less, as surveyed by ESI Services, Inc., Beckley, West Virginia. Map for said property is recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Map Book 5056, Page 0556.

And being the same property conveyed to Town of Sophia Sanitation by Bradley Sadler in that certain deed dated the 4th day of November, 2021 of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 5075, at Page 1484.

TRACT NO. 3:
Beginning at a 5/8-inch rebar with cap, found on the northerly right of way line of Independence Road (West Virginia County Route 29/2), said rebar being a common corner of Bradley Sadler (Book 5057, Page 9979) and Beaver Coal Company, Limited, (Book 5037, Page 5289), thence leaving Bradley Sadler (Book 5057, Page 9979), and with the northerly right of way line of Independence Road the following two (2) calls:

With a curve to the right having a radius of 924.93 feet, an arc distance of 24.37 and a chord bearing and distance of North 58° 45’ 32” West, 24.37 feet to a point; thence North 58° 00’ 15” West, 122.28 feet to a 5/8-inch rebar with cap, set, thence leaving the northerly right of way line of Independence Road and with new lines running through Beaver Coal Company, Limited (Book 5037, Page 5289) to following twelve (12) calls:

North 37° 43’ 55” East, 69.76 feet to a 5/8-inch rebar with cap, set;

North 66° 27’ 35” East, 124.83 feet to a 5/8-inch rebar with cap, set;

South 56° 30’ 50” East, 54.66 feet to a 5/8-inch rebar with cap, set;

North 68° 02’ 13” East, 116.44 feet to a 5/8-inch rebar with cap, set;

North 42° 36’ 52” East, 266.36 feet to a 5/8-inch rebar with cap, set;

South 78° 12’ 48” East, 121.46 feet to a 5/8-inch rebar with cap, set;

South 53° 44’ 58” East, 208.61 feet to a 5/8-inch rebar with cap, set;

South 14° 41’ 45” East, 357.38 feet to a 5/8-inch rebar with cap, set;

South 45° 46’ 04” West, 126.16 feet to a 5/8-inch rebar with cap, set;

South 81° 56’ 18” West, 97.16 feet to a 5/9-inch rebar with cap, set;

North 69° 30’ 04” West, 182.05 feet to a 5/8-inch rebar with cap, set;

South 80° 48’ 29” West, 68.98 feet to a 5/8-inch rebar with cap, set, on the northerly right of way line of Independence Road, thence with the northerly right of way line of Independence Road;

With a curve to the left having a radius of 488.37 feet, an arc distance of 110.27 feet and a chord bearing and distance of North 61° 37’ 30” West, 110.03 feet to a 5/8-inch rebar with cap, found, on the northerly right of way line of Independence Road, said rebar being a common corner of Bradley Sadler (Book 5057, Page 9979) and Beaver Coal Company, Limited, (Book 5037, Page 5289), thence leaving the northerly right of way line of Independence Road and with common lines of Bradley Sadler (Book 5057, Page 9979) and Beaver Coal Company, Limited, (Book 5037, Page 5289) the following three (3) calls:

North 19° 50’ 58” East, 94.70 feet to a 5/8-inch rebar with cap, found;

North 73° 39’ 44” West, 219.03 feet to a 5/8-inch rebar with cap, found;

South 40° 19’ 10” West, 68.37 feet to the Point of Beginning containing an acreage of 6.332 acres, more or less, as surveyed by The Thrasher Group, Inc. in March of 2017.

TRACT NO. 4:
That certain portion of Hot Coal Road extending from the First Tract described hereinabove to the junction of Independence Road.

The Petition for annexation has been available for public inspection in the Mayor’s Office, Sophia Town Hall, Sophia, West Virginia since September 24, 2024, all interested citizen are invited to attend the public hearing scheduled for October 17, 2024, at 4:00 p.m. at Town Hall.
