Notice is hereby given that PINNACLE MINING COMPANY, LLC, 302 SOUTH JEFFERSON STREET, , ROANOKE, VA 24011 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 390 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV 25840, for renewal of Article 3 Permit Number O402292 to operate Smith Branch Coal Refuse Impoundment in the N/A seam of coal.
The operation is discharging into an Un-named Tributary of Pinnacle Creek, Smith Branch of Pinnacle Creek, and Pinnacle Creek of Guyandotte River and is located 1.5 miles, South of NEW RICHMOND in CENTER District of Wyoming County, Longitude 81o 30‘ 6“ and Latitude
37o 32‘ 1“ (Coordinates from USGS Topographic Map).

Written comments and/or requests for an informal conference of the permit renewal application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until December 19, 2024, or thirty (30) days from the date of final publication.
