TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated July 19, 2006, and duly recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Document No. 245975, in Book No. 2102, at Page 467, Salvador Diaz and Janice Diaz did convey unto Barry Dobson and Mark A. McCoy, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Fourth Avenue Entrance of the Cabell County Courthouse in Huntington, West Virginia, on November 26, 2024 at 2:00 PM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 05 – Gideon District, Cabell County, West Virginia, and more particularly described as follows: All of that certain lot or parcel of real estate, situate in the City of Huntington, Gideon District, Cabell County, West Virginia, and more particularly bounded and described as follows, to-wit: Beginning at a point of intersection of the westerly line of Chestnut Drive, as said Drive is described in a Deed from Buford C. Tynes, unmarried, and Lillian C. Hall, widow, to the City of Huntington, dated the 15th day of March, 1938, and of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 305, at page 6, with the west line of Tynes Lanes, as shown on a map of Steadman-Taylor Subdivision, of record in said Clerk’s Office in Map Book 5, as Map 83, said point of intersection being northwesterly with a curve to the right having a radius of 120 feet, a distance of 75.43 feet from the northwest corner of the lot conveyed by the said Tynes and Hall to Roderick W. Cash and Fannie Cash, by deed dated the 20th day of August, 1951 and of record in said Clerk’s Office in Deed Book 450 at page 91, said beginning point being the most easterly corner of a lot conveyed by the said Tynes and Hall to Henry W. Diehl and Frances S. Diehl, by deed dated the 10th day of January, 1945, and of record in said Clerk’s Office in Deed Book 344, at page 139 (494); thence, with the said line of Tynes Lane, southerly, curving to the right with a radius of 106.09 feet, a distance of 58.17 feet; thence, South 15 degrees 55 minutes West 102.31 feet; thence, with the northerly line of the land heretofore conveyed by the grantor and his wife, to Thomas G. Folsom and Ione Folsom by deed dated the 3rd day of July, 1962, and of record in said Clerk’s Office in Deed Book 597, at page 52, North 73 degrees 55 minutes West, 152.41 feet to a point; thence, North 11 degrees 48 minutes East 125.99 feet to the southwest corner of said Diehl lot; thence, with the south line of said Diehl, curving to the left in an easterly direction with a radius of 230 feet, a distance of 80.28 feet; thence, curving to the right in an easterly direction with a radius of 90 feet, a distance of 57.8 feet; thence, curving to the left in a north easterly direction with a radius of 9.5 feet, a distance of 22.75 feet to the point of beginning. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 21 Chestnut Dr Apt 601, Huntington, WV 25705-3519. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale.
