NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by the virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated August 16, 2021, executed by the Borrower, Jon Thomas Wilkes, to Robert H. Skeen, Jr., the Trustee, of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Book 2853, at Page 111. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1111 Newmans Branch, Milton, WV 25541, and, upon information and belief, may now be known as 405 Newmans Branch Rd., Milton, WV 25541. Pill & Pill, PLLC was appointed as Substitute Trustee by a SUBSTITUTION OF TRUSTEE dated February 10, 2025, of record in the Clerk’s Office in Book 422, at Page 596. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Cabell County, in Huntington, West Virginia on the following date: April 7, 2025, at 11:23 a.m. All that certain piece or parcel of real property situate in the City of Milton, Cabell County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at a 5/8″ rebar set in the southern right-of-way line of Interstate 64 and being the most northeast corner to a tract of land owned by Jack L. Midkiff, Deed Book 905, Page 138; thence S. 79 29’01” E., 134.53′ leaving said Midkiff’s land and running with said I-64 to a 5/8″ rebar set in the western right-of-way line of W.Va. Sec. Rt. 9; thence, S. 32 03’25” E. 114.73′, leaving said I-64 and running with said W.Va. Sec. Rt. 9 to a 3/4″ rebar set; thence, S. 19 50’09” E., 71.29′ running with same to a 3/4″ rebar set; thence, S. 4 58’03” E. 74.58′ running with same to a 3/4″ rebar set; thence, S. 19 09’09” W., 114.48′ running with same to a 5/8″ rebar set by a fence post at the most northeast corner to a tract of land owned by Charles Bias, Deed Book 812, Page 725; thence, N. 75 19’12” W. 158.50′ leaving said W.Va. Sec. Rt. 9 and running with said Bias land to a 5/8″ rebar set by a fence pot being a corner to said Midkiff’s land; thence N. 79 32’09” W., 111.29′ leaving said Bias land and running with said Midkiff’s land to a 5/8″ rebar set; thence N. 13 49’32” E. 320.19′ continuing with said to the point of BEGINNING and containing 1.78 acres, more or less. For a more particular description reference is hereby made to that certain plat prepared by Donald R. Hayes, L.L.S. 902, dated March 16, 1994 entitled “A Plat Showing a Re-survey of a Balance Tract of Land Being 1.78 Acres Owned by Glen Cash, Deed Book 335, at Page 321, Situate in the Town of Milton District, Cabell County, West Virginia”, a copy of which is of record in the Office of the Clerk of the County Commission of Cabell County, West Virginia. AND BEING the same real estate conveyed unto Jon Thomas Wilkes by the Deed dated the 16th of August, 2021, from Jackie Lee Willis Wysong and Peggy Lee Wysong, and recorded in the Office of the Clerk of the County Commission of Cabell County, West Virginia, in Deed Book 1450, at Page 355, and the Deed dated the 2nd day of December, 2021, from Jackie Lee Willis Wysong and Peggy Lee Wysong, and recorded in the aforesaid Clerk’s Office in Deed Book 1454, at Page 433. TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-2-1. 3) The Beneficiary and/or Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after foreclosure sale will be deeded to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the sate of sale, with ten percent (10%) of the total purchase price payable to the Trustee at sake, Pill & Pill, PLLC, Substitute Trustee BY: Jonathan L.
