The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated October 17, 2018, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5068, at Page 5976, James L. Oaks and Carol Sue Oaks did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on
April 8, 2025, at 1:06 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Beckley District, Raleigh County, West Virginia, and more particularly described as follows:
A certain lot or parcel of land, together with all improvements thereon and appurtenances thereunto belonging, situate on the east side of First Avenue, City of Beckley, Raleigh County, West Virginia, and being shown and designated on a map attached to and made part of a deed from Cleo Corey, widower and single, to John W. Tindillia and Zelma Tindillia, his wife, by deed dated May 9, 1967, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 457, at Page 395, to which said map and deed reference is here made, said lot or parcel of land being more particularly bounded and described as follows:
BEGINNING at a point on the east side of First Avenue at the end of a block wall, a corner to Pete Corey, said point being N. 10° 35’ E. 35.00 feet from the north line of Fairlawn Avenue; thence with line of Pete Corey and block wall, chain link fence and old wire fence S. 79° 13’ E. 150.63 feet to a stake in the sideline of Lot No. 11, Fairlawn Subdivision, said hub being 11.10 feet from the end of the chain link fence; thence, through Cleo Corey Lot N. 13° 31’ E. 69.98 feet to a hub in the side-line of M. M. Corey lot; thence with M. M. Corey lot N. 81° 29’ W. 154.30 feet to a point on First Avenue; thence with First Avenue S. 10° 35 W. 63.80 feet to the beginning, containing 10,183 square feet.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 119 First Avenue, Beckley, WV 25801.
AND BEING the same real estate which was conveyed to James L. Oaks by Deed dated October 14, 1977, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 589, at Page 163.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
