TRUSTEE’S SALE OF VALUABLE REAL ESTATE
The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated March 2, 2022, and duly recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed of Trust Book 482, at Page 925, Robert E. Holmes, Jr. and Monica S. Holmes did convey unto Carl D. Andrews, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Morgan County Courthouse, in Berkeley Springs, West Virginia, on
April 22, 2025, at 1:02 PM
The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Cacapon District, Morgan County, West Virginia, and more particularly described as follows:
The following described real estate, together with all the rights-of-way, improvements, rights, privileges, and appurtenances hereunto belonging, situate in Cacapon District, Morgan County, West Virginia, more particularly described as follows:
“Beginning at two sarvis, an original corner of the entire survey of which this survey is a part, and John K. Whitford; thence S. 70-1/2 E. 78 poles to a stake northeasterly from a large sycamore, and on the east side of the Long Hollow Run; thence, leaving the original line and extending into and through the entire survey of which this survey is a part S. 27-1/4 W., crossing and recrossing the Long Hollow Run for a distance of 48 poles to three willows east of Long Hollow run; thence, N. 70-1/2 W. 13-1/4 poles to the middle of the Long Hollow Road, thence, S. 54 W. 6 poles to a point in the middle of said road, and south side of a culvert crossing a drain; thence, N. 70-1/2 W. 60-1/2 poles to a planted stone at a point between two drains; thence, N. 25-1/2 E. with the original west side line of the entire survey 54-3/4 poles to the place of beginning, containing twenty-five acres, more or less.”
Excepting and reserving from this conveyance a parcel of real estate containing one-fourth acre, more or less, and being all the land embraced in the 25-acre described hereinabove, lying on the east side of State Route No. 9; it being the express purpose of this deed to convey to said party of the second part the real estate lying on the west side only of said State Route 9.
There is further excepted and reserved from the above-referenced 25 acre tract that certain 13,360 acre parcel, as designated on the plat of “Nelson Acres – A division of the land of James L. Burns”, dated July 12, 2005, made by Berkeley Land Surveys, Inc. which plat is of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 217 at Page 140, and being the same real estate conveyed to RNB, LLC, a West Virginia Limited Liability Company, by Deed of James L. Burns, dated November 4, 2005 and recorded in the aforesaid Clerk’s Office in Deed Book 217 at Page 138.
And further being the same property shown as 6.821 acres and 2.372 acres on Berkeley Land Surveys Plat No. 2005139 of Nelson Acres; of record in said Clerk’s Office in Deed Book No. 217, at Page 140.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 6340 Cacapon Road, Great Cacapon, WV 25422.
AND BEING the same real estate which was conveyed to Robert E. Holmes, Jr. and Monica S. Holmes, by Deed dated April 15, 2013, from Springleaf Home Equity, Inc, and recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 245, at Page 226.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
