Notice is hereby given that Pocahontas Coal Company, LLC, 109 Appalachian Drive, Beckley, WV 25801 has submitted an application to the Department of Environmental Protection (DEP), Division of Mining and Reclamation (DMR) located at 1159 Nick Rahall Greenway, Fayetteville, WV 25840 for an Article 3 permit for the surface disturbance of approximately 254.35 acres in order to construct, operate, and maintain a surface mine with highwall / auger mining within one hundred (100) feet of County Route 44/1 and within one hundred (100) feet of and on the non-maintained right-of-ways of County Routes 44/1 and 44/2 in the Pocahontas No. 6 and all associated riders and splits thereof seam of coal. The proposed operation is discharging into Unnamed Tributaries of/and Lampkin Branch, Unnamed Tributaries of/and Laurel Creek, and Unnamed Tributary of Piney Creek, all of Piney Creek of New River of Kanawha River and is located 3.1 miles, northeast of Odd in Shady Spring District of Raleigh County, Longitude 81° 10’ 44” and Latitude 37° 38’ 18”.

Written comments and/or requests for an informal conference of the surface mining application shall identify the applicant and application number and will be received by the Permit Supervisor at the DEP address above until June 1st, 2025, or thirty (30) days from the date of final publication. A copy of the application will be available for review until June 1st, 2025, or thirty (30) days from the date of final publication in the DEP Regional Office located at the address above and is available at:
