Notice of Public Auction
Under the authority of the Order of the Honorable Thomas H. Ewing, Judge of the Circuit Court of Fayette County, West Virginia, entered on March 31, 2025. in the matter of Petition to Sell Real Estate, Civil Action No. 22-G-9, the undersigned Conservator appointed by the Court pursuant to said authority given, will, on May 30, 2025, at 1:00 p.m. at the front door of the residence of 111 Laurel Terrace located in Beckley, Raleigh County, West Virginia, offer for sale the following tracts or parcels of surface land, together with the improvements thereon, appurtenances thereunto belonging and rights incidental thereto: Beckley District. Tax Map 41, Parcel 41012600000000 (1-41-126); Parcel 1-41012500000000 (1-41-125) with such property consisting of a residence and approximately 0.0800 on Parcel (1-41-126); and 0.1100 on parcel 1-41-125, Raleigh County Assessor Account Numbers 06125846 and 06125855.
And further being a portion of the two surface tracts described in a deed record book with the Raleigh County Commission for Raleigh County, West Virginia, in Deed Book 5010, page 159. both tracts being named.
The above described and/or referenced tracts or parcels of surface land shall be conveyed by the undersigned conservator to the purchaser by a deed without warranty of any kind, expressed or implied, and made subject to all property taxes and prior liens, including any liens for sewer service assessed by any municipality or public service district, reservations, encumbrances, restrictions, right of way, easements, covenants, conveyances and conditions of record in said Clerk’s office of the affecting the subject property.
The property is to be sold AS IS.
The Conservator shall be under no duty to cause any existing co-tenant, tenant or other person occupying the subject property to vacate said property.
TERMS OF SALE: Ten (10%) percent down, the remaining balance due with approval of the Circuit Court. The minimum bid starts at $28,600.00.
The above real estate will be sold by the Conservator at the auction to the highest bidder, subject to the right of the Circuit Court of Fayette County, West Virginia, to approve or reject any and all bids. Ten (10%) percent of the purchase price shall be paid to the Conservator to be held in trust from the date of the sale, and the balance must be paid on the date the bid is approved by the court.
CONTINUANCE-ADJOURNMENT OF SALE:
The undersigned Conservator reserves the right to continue the sale or to adjourn the sale, for a time, or from time to time, without further notice by an announcement at a time and place of the sale as hereinbefore set forth for any continuance or adjournment thereof.
