Notice is hereby given that Prime Met, Inc. 836 Euclid Avenue, Suite 302, Lexington, KY 40502 has submitted an application for the modification of Article 11/WVNPDES Permit No. WV1016491 to the Department of Environmental Protection, 601 57th Street SE, Charleston, WV 25304 in order to add Outlet 045, delete Outlet 032, and change Outlets 003, 004, and 008 to active status.

The operation will discharge Treated Stormwater into Bobs Fork of Franks Fork of Laurel Fork, Franks Fork of Laurel Fork, and Laurel Fork of Clear Fork of Guyandotte River of the Upper Guyandotte River and is located 1.8 miles, Northeast of Glen Rogers, in Slab Fork Districts of Raleigh and Wyoming Counties, Longitude 81° 23’ 57” and Latitude 37° 44’ 6” (Coordinates from USGS Topographic Map).

The Department of Environmental Protection is seeking information on private surface water intakes for human consumption located in the above listed receiving streams and located downstream of this operation. Please provide your name, phone number, mailing address, the name of the stream being with the intake, and the physical location of the intake. This information needs to be submitted to the address above.

An anti-degradation review has been conducted. Tier 1 protection is afforded because effluent limitations ensure compliance with water quality criteria for all designated uses. Where applicable, Tier 2 protection is also afforded because the agency has made a determination that the discharge will not cause significant degradation to the receiving stream for any parameters of concern.

Written comment and/or requests for an informal conference of the application shall identify the applicant and application number and will be received by the Supervisor at the DEP address above until June 20th, 2025, or thirty (30) days from date of final publication. Notice is hereby given that the following has been appealed from the action of the City Manager in refusing to grant the following zoning permit:

Application # 10,364 by Loren Preston to operate a community garden, art, tool library and flower collection at 223 Davidson Street.

• Reason for Refusal: Section 44-86 Zoned RMF- Other public and semipublic uses of educational, cultural, institutional, social, or recreational character, not including correctional or penal institutions, which serve residents of the neighborhood or community.

Application # 10,365 by Tammy Oswald to install a six-foot chain-link fence in the front yard.

• Reason for Refusal: Section 44-90 Accessory uses in residential areas. A fence or enclosure wall shall not exceed a height of three feet when located along the front line or when located on any sideline, from the front lot line to the setback line. All wire fences are prohibited along front and side lines, except by approval of the zoning board of adjustment.

Application # 10,366 by Ivy Buchanan to operate a flower shop at 1019 Groveland Drive.

• Reason for Refusal: Section 44-90 Zoned R1- Zoning Board of Adjustments may be authorized by special exception.

Application #10,367 by Margie Herter to install a 6-foot privacy fence in the front yard of 1284 Heatherwood Road.

• Reason for Refusal: Section 44-90 Accessory uses in residential areas.
