TRUSTEE’S SALE OF VALUABLE REAL ESTATE NOTICE OF TRUSTEE’S SALE is hereby given pursuant and by virtue of the authority vested in the Trustee, C. William Harmison, Harmison & Associates, PLLC, by that certain Deed of Trust executed by Seth Brittingham and Kaylynn Brittingham unto C. William Harmison, Trustee to secure Carl P. Hill and Leslie A. Hill, the beneficial owners of that certain Deed of Trust dated the 1st day of January, 2024, of record in the office of the Clerk of the County Commission Morgan County, West Virginia, in Deed of Trust Book No. 506, at Page 756. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owners so to do, will offer the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Berkeley Springs, Morgan County, West Virginia, on the following date: WEDNESDAY, JUNE 25, 2025 AT 9:00 A.M. All that certain tract or parcel of real estate, together with all the rights, rights of way, easements, privileges, improvements and appurtenances thereunto belonging, situate in Cacapon District, Morgan County, West Virginia, and being more particularly described follows: Lot 13, containing 68.17 acres, as identified on the “Plat of Survey of Realignment of Lots in Imperial Orchard Subdivision” prepared by Berkeley Land Surveys, Inc. (Plat No. 2007180), which plat is of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Plat Book 8, Page 149, to which plat reference is made for a more particular description of said parcel of real estate. Together with a nonexclusive right for all legal purposes to all easements and rights-of-way as shown on said “Plat Survey of the Realignment” of lots leading from West Virginia Route 9 over a 40 foot right-of-way identified as a portion of Monica Trail, the “new 40 foot wide right-of-way” and Heather Trail. Said plat also identifies the right-of-way known as Monica Trail as shown on the original plat of lots of Imperial Orchard Subdivision of record in the aforesaid county clerk’s office in Map Book 6, Page 148. That portion of Monica Trail so identified is not an appurtenance to the real estate herein conveyed and the Grantee shall have no right to use said abandoned right-of-way. AND BEING the same real estate granted and conveyed from Carl P. Hill unto said Seth Brittingham and Kaylynn Brittingham, husband and wife, by deed bearing date the 1st day of February, 2022, of record in the office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 285, at page 486. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate is reported to have a mailing address of: 427 Avalanche Trail, Paw Paw, West Virginia 25434. TERMS OF SALE 1) The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-21-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Terms of the sale are 10 percent in cash, certified check or other form acceptable to the Trustee to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
