EMERGENCY ORDINANCE ADOPTED

TO: CITIZENS OF THE CITY OF FAIRMONT:

The Council for the City of Fairmont at a regular meeting held July 8, 2025, introduced, publicly read, and adopted the following Emergency Ordinance:

EMERGENCY ORDINANCE NO. 2077

AN EMERGENCY ORDINANCE OF THE COUNCIL FOR THE CITY OF FAIRMONT TEMPORARILY SUSPENDING THE PERMIT FEES REQUIRED BY SECTION 1709.02 SCHEDULE FOR PERMIT FEES OF ARTICLE 1709 STATE BUILDING CODE OF THE FAIRMONT CITY CODE FOR PERSONS IMPACTED BY THE JUNE 15, 2025, FLOOD EVENT; ALL OTHER PROVISIONS OF SAID STATE BUILDING CODE PRESERVED.

WHEREAS, The City of Fairmont experienced a severe flood event on June 15, 2025, which has created a public emergency in the City of Fairmont affecting life, health, property, and the public peace.

WHEREAS, in order to provide some relief to the flood victims from the effects of the flooding and the resulting property damage, the Council for the City of Fairmont deems it expedient to provide for the temporary suspension of the permit fees required by Section 1709.02 Schedule for Permit Fees of Article 1709 State Building Code of the Fairmont City Code.

WHEREAS, this ordinance is deemed an emergency ordinance pursuant to the provisions of Section 2.14 of the Charter for the City of Fairmont and West Virginia Code §8-11-4.

NOW, THEREFORE, BE IT ORDAINED BY THE COUNCIL FOR THE CITY OF FAIRMONT THAT:

SECTION 1. Finding of Emergency: Council for the City of Fairmont hereby finds that the flood event of June 15, 2025, and resulting property damage, has caused a public emergency in the City of Fairmont affecting life, health, property, and the public peace, which emergency will continue to exist until the effects of the flooding and resulting property damage have been mitigated.

SECTION 2. Suspension of Permit Fees: In order to meet said emergency and to provide some relief to the flood victims, Council for the City of Fairmont hereby temporary suspends the permit fees required by Section 1709.02 Schedule for Permit Fees of Article 1709 State Building Code of the Fairmont City Code, upon a showing by the applicant of proper proof in such forms acceptable to the Building Inspector, or his designee, that the need for any such permit has resulted from property damage caused by the flood event of June 15, 2025.

SECTION 3. Nothing herein shall be construed to eliminate or suspend any other requirement of Article 1709 State Building Code, including but not limited to the need for permits for construction projects, permits for demolition projects, plans requirements or examinations, and inspections, and all such requirements shall be and are hereby preserved and shall remain in full force and effect and strictly enforced together with all resulting penalties for non-compliance, all as provided by said Article 1709 State Building Code

SECTION 4: Effective Date: This Emergency Ordinance shall become effective upon adoption and shall automatically stand repealed as of the 61st day following said date; provided however, it may be re-enacted in the manner specified in Section 2.14 Emergency Ordinance of the City Charter, if the emergency still exists.

This EMERGENCY ORDINANCE adopted this the 8th day of July, 2025.

The purpose of the adoption of the Emergency Ordinance is necessary in order to provide some relief to the flood victims from the effects of the flooding that occurred on June 15, 2025. As the result of property damage, the Council for the City of Fairmont deems it expedient to provide for the temporary suspension of the permit fees required by Section 1709.02 Schedule for Permit Fees of Article 1709 State Building Code of the Fairmont City Code.

PLANNING COMMISSION
OF THE CITY OF BECKLEY

Notice is hereby given that the City of Beckley Planning Commission will hold a public hearing at 4:00 p.m., Tuesday, the 5th of August 2025 in Council Chambers of the Beckley Municipal Building, 409 South Kanawha Street, in the City of Beckley on the petition of Walmart Real Estate Business Trust, owner, requesting Site Plan approval for a
3,500 sq. ft. addition located at 1330 N. Eisenhower Drive (Tax Map 72, Parcel 2) in a B-2, General Commercial Business District.

Anyone wishing to be heard concerning this matter should be at the time and place indicated and must register to speak prior to the start of the meeting.
