NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated July 3, 2002, executed by Borrower(s), Harry H Ullerup and Myra L Ullerup, to James B Crawford, III, the Trustee of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book 5007, at Page 5562. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 326 E Prince St, Beckley, WV 25801. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated July 7, 2023, of record in the Clerk’s Office in Book 5080, Page 6135. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustees will sell the following described property to the highest bidder at the front door of the Courthouse of Raleigh County, in Beckley, West Virginia, on the following date:
18th day of August, 2025 at 11:45 a.m.
That certain parcel of land situate in the City of Beckley, Raleigh County, West Virginia, and being Lot No. 31, Section 40 of the McCreery Court Addition, said Lot No. 31 being more particularly bounded and described as follows:
Beginning at a set ½ inch steel pin in the south line of East Prince Street (formerly Fourth Street) point being a common corner to Lots Nos. 30 and 31; thence leave Lot No. 30 and with the north line of East Prince Street S63°19`E for 29.90 feet to a set ½ inch steel pin in the west right of way line of Appalachian Power Co.; thence leave East Prince Street and with said Power Co, S4°12`E for 39.15 feet to a set ½ inch steel pin in said Line, point being a corner to Lot No. 32; thence leave said Power Co. and with the dividing line of Lots Nos. 31 and 32 S26°41`W for 116.40 feet to a set ½ inch steel pin in the North Line of a 12 foot Alley; thence leave Lot No. 32 and with said Alley N63°19`W for 50.00 feet to a set ½ inch steel pin in said north line of Alley, point being a common corner to Lots Nos. 30 and 31; thence leave said Alley and with the dividing line of Lots Nos. 30 and 31 N 26°41`E for 150.00 feet to beginning, containing 7,162.3 square feet as surveyed as Dennis J. Lilly of Beckley, West Virginia Land Surveyor License No. 256.
And being the same property conveyed to Harry H. Ullerup and Myra L. Ullerup, his wife, by Deed dated July 1, 1991, from Donald E. Harris and Carol D. Harris, his wife, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, on Roll 12, at page 2089.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property
from time to time by written or oral proclamation, which continuance
shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
