NOTICE OF TRUSTEE’S SALE
NOTICE IS HEREBY GIVEN that by virtue of a certain Deed of Trust dated February 8, 2024, and of record in the office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed of Trust Book No. 505, at page 661, made by Rodger W. Williams IV as Grantor, to Charles S. Trump IV and George I. McVey, as Trustees, to secure CNB Bank, Inc. as Beneficiary (hereinafter referred to as the “Deed of Trust”), in the payment of the maximum principal sum of Seventy-One Thousand Two Hundred Fifty and 00/100 Dollars ($71,250.00), evidenced by a promissory note dated February 8, 2024 (hereinafter referred to as the “Note”), and pursuant to the Deed of Trust wherein CNB Bank, Inc. was authorized and empowered to remove the trustees appointed in the Deed of Trust and appoint substitute trustees in the place and stead of the trustees named in the Deed of Trust, Kenneth J. Barton, Jr. and Shelby R. Turley, either of whom may act, having been so appointed as Substitute Trustees by the terms of a Substitution of Trustee of record in said Clerk’s office in Deed of Trust Book No. 521, at page 561, and default having been made in the payment of said indebtedness and the Substitute Trustee having been requested in writing so to do by CNB Bank, Inc., the owner and holder of said note, said Substitute Trustee, on
THURSDAY, the 14TH DAY OF AUGUST, 2025, at 11:00 A.M. ET, will offer for sale and sell at public auction in front of the Morgan County Courthouse, 77 Fairfax Street, Berkeley Springs, West Virginia, to the highest bidder therefor, all of the following described realty, together with its improvements and appurtenances, situate, lying and being in Sleepy Creek District, Morgan County, West Virginia, and more particularly described as follows:
Lot 5B Hawks Nest II-Beginning at an iron rod, found, being the northeast corner to Joan Orsini and Robert Crouse (DB 172, PG. 813-Lot 5A Hawks Nest II), in the west line of Kenneth and Sandra Hewett (DB 164, Page 385-20 Acres); thence, with said Lot 5A, S. 84º 19’ 06” W. 748.97 feet to an iron rod, found, being the northwest corner to said Lot 5A, in the east line of Lot 3; thence, with said Lot 3, N. 26º 115’ 02” W. 180.27 feet to an iron rod, found, being the southwest corner to Gregory and Sheila Copenhaver (DB 171, Pg. 539-Lot 6); thence, with same N. 77º 20’ 39” E., 391.30 feet to an iron pipe, found, being Copenhaver’s southeast corner, and continue same course 655.16 feet (in all 1046.46 feet) to an iron rod, found, being corner to said Kenneth and Sandra Hewett; thence, with the center of a 40 foot wide right-of-way, S. 01º 50’ 50” E., 165.43 feet; thence, S. 25º 16’ 46” W. 57.58 feet; thence, S. 53º 46’ 07” W., 66.43 feet; thence, N. 80º 45’ 25” W., 133.04 feet; thence running along the east side of another 40 foot wide right of way, S. 05º 40’ 54” E., 81.99 feet to the point of beginning, containing 5.02 acres. TOGETHER WITH AND SUBJECT TO any and all recorded easements and rights-of-way appurtenant thereto for ingress, egress, and utilities, including but not limited to, those set forth on the aforementioned plat. EXCEPTING AND RESERVING a 40 foot wide right of way as shown on plats of record in Deed Book 164, at Page 385, Deed Book 171, page 539, and the plat of Lot 5A in Deed Book 172, Page 813.

The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases, and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes assessed against said property, and to any further matters announced at said sale.
The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of record, if any, having priority over the Deed of Trust.
Any sale hereunder may be adjourned from time to time without notice other than oral proclamation at the time and place appointed for the sale. The Successor Trustee reserves the right to reject any or all bids.
TERMS OF SALE: 10% cash in hand on day of sale, and the balance in cash at closing within 30 days of the date of the sale. The purchaser(s) shall pay for transfer stamps and recording fees. Additional terms of sale may be announced prior to the sale.
