The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated November 8, 2001, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5005, at Page 9055, Janet Leigh Birchfield did convey unto Todd Taylor and Dan Kennedy, Trustees, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, in Beckley, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:
TRACT ONE: The surface of Lot No. 26 of the Deanfield Addition of the Chas. Stansbury Estate situate in Glen Daniel, Trap Hill District, Raleigh County, West Virginia, as shown on a MPA of said Addition entitled “Deanfield Addition of the Chas. Stansbury Estate, Glen Daniel, W. Va.,” of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map Book 7, at Page 23.
And being the same property acquired by Danny L. Birchfield and Janet Leigh Birchfield,his wife, by Deed from Elsie Claypool and Charles Claypool, her husband, by Deed dated the 3rd day of October, 1983, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia,in Deed Book 678, at Page 509.
TRACT TWO: The surface of the following lots or parcels of land situated in the Deanfield Addition of Chas. Stansbury Estate, Glen Daniel, Trap Hill District, Raleigh County, West Virginia, and more particularly described as follows:
BEING Lots Nos. Twenty-seven (27), Twenty-eight (28), Twenty-nine (29), Thirty (30), Fifty-five (55), Fifty-six (56) and Fifty-seven (57) of the Deanfield Addition of the Chas. Stansbury Estate, as shown on a map of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, with a deed from H.A. Stansbury to A. Lucas.
And being the same property heretofore acquired by Danny L. Birchfield and Janet Leigh Birchfield, his wife from Phyllis Clowers and Earl R. Clowers, her husband, Ford Dalton and Opal Mae Dalton, his wife, by Deed dated the 28th day of September, 1978, and of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 603, at Page 537.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 133 Claypool Hollow Road, Glen Daniel, WV 25844.
AND BEING the same real estate which was conveyed to Janet Leigh Birchfield, by Deed dated February 15, 2000, from Danny L. Birchfield, and recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 5001, at Page 9271.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
