NOTICE OF TRUSTEE’S SALE
NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, Pill & Pill, PLLC, by that certain Deed of Trust dated March 31, 2022, executed by Borrower, Monica N Nelson, to Pam Zagula, Attorney at Law, the Trustee, of record in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Book 885, at Page 2103. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 1284 Cove Rd., Weirton, WV 26062. Pill & Pill, PLLC was appointed as Substitute Trustee by an APPOINTMENT OF SUCCESSOR TRUSTEE dated February 11, 2025, of record in the Clerk’s Office in Book 904, at Page 2319. The Borrower defaulted under the Note and Deed of Trust and the Substitute Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Substitute Trustee will sell the following described property situate in Weirton (formerly Butler) District, Hancock County, West Virginia, together with the improvements thereon and the appurtenances thereunto belonging, to the highest bidder at the front door of the Courthouse of Hancock County, in New Cumberland, West Virginia, on the following date:
August 20, 2025, at 9:00 a.m.
PARCEL NO. 1
All of that certain tract or parcel of land, situate in the District of Butler, County of Hancock, and State of West Virginia, bounded and described as follows: BEGINNING at a point (formerly an iron pin) on the south line of a state road (State Route #33, also known as Cove Road), said point being the northeast corner Lot No. One (1) of the Woodland Estates Plan and on record in the Office of the Clerk of the County Court of Hancock County, West Virginia, in Plat Book No. 2, page 53. Said place of beginning also being the same as mentioned in Deed of Three Springs Development Company, Inc., to Cove Hill Coal Company, dated July 25, 1940, and on record in the office of the Clerk of the County Court of Hancock County, West Virginia, Deed Book No. 57, Page 181, thence by the dividing line between said Lot No. One (1) of Woodland Estates and lands of the Cove Hill Coal Company, S. 27 degrees 44 ‘ E., for 30.00 feet to a point on said dividing line; thence N. 43 degrees 03 ‘ 05 ” E., for 31.27 feet to a point, thence N. 27 degrees 44 ‘ W., for 25.00 feet to a point on the south side of above mentioned Cove Road, thence by same S. 52 degrees 06 ‘ W., for 30.00 feet to the place of beginning, containing .02/100 acres, more or less.
PARCEL NO. 2
All of that certain tract or parcel of land, being a part of Lot No. Two (2) of the Woodland Estates Subdivision No. 1, situate in the District of Butler, County of Hancock and State of West Virginia, more particularly described as follows: BEGINNING at a point on the north side of a forty (40) foot street known as Hindman Lane, being the southwest corner of Lot No. Two (2) running thence along the westerly line of said Lot No. Two (2), N. 19 degrees 57 minutes 91 seconds W. 233.80 feet to a point, which point is the true beginning of parcel to be conveyed, thence N. 19 degrees 57 minutes and 51 seconds W. 102.95 feet to a point, being the northwest corner of Lot No. Two (2); thence N. 46 degrees 15 minutes E. 57.0 feet to a point, thence N. 46 degrees 23 minutes E. 43.0 feet to a point in the east line of Lot No. Two (2), thence along the same, S. 22 degrees 33 minutes 41 seconds E. 123.60 feet to a point, thence S. 64 degrees 40 minutes W. 101.03 feet to the place of true beginning. The grantor further conveys to the grantee, her heirs and assigns, the right to the use of the right of way easement across the parcel of land conveyed by the Cove Hill Cove Company to Hanford Lamp and Norma Lamp, his wife, by deed dated this 29th day of June, 1956, and of record in the Office of the aforesaid County Clerk.

All that certain lot or parcel of land situate in the District of Butler, County of Hancock, and State of West Virginia, and more particularly described as follows: Beginning at a point, the said point being the Southwest corner of the said Lot No. 1 and the Southeast corner of Lot No. 2 adjoining Hindman Lane; thence N 22 degrees 31 ‘ 41 ” W 105.5 feet to a point in the dividing line of Lot No. 1 and Lot No. 2, said point being the place of beginning of the parcel about to be described; thence N 22 degrees 33 ‘ 41 ” W 237.78 feet to a point being the Northwest corner of Lot No. 1; thence N 46 degrees 23 ‘ E 117.83 feet to a point being the Northeast corner of Lot No. 1; thence S 27 degrees 44 ‘ E 363.13 feet to a point in the easterly line of Lot No. 1; thence N 82 degrees 55 ‘ 30 ” W 165 feet to the place of beginning. There is excepted from the above parcel a certain piece of property conveyed to Michael Sweat, married, by deed of Ronald D. Lamp and Barbara J. Lamp, husband and wife, dated October 9, 1997, and recorded in the Office of the Clerk of the County Court of Hancock County, West Virginia in Deed Book No. 240, page 369. Said parcel is more fully described as follows: All that certain lot or parcel of land situate in the City of Weirton, formerly Butler District, Hancock County, West Virginia, and more particularly described as follows: Beginning at an iron pin, found, on the north line of Hindmans Lane, said iron pin being the common southern corner of Lots 6 and 7, Woodland Estates Subdivision as recorded in Plat Book 2 at Page 53, in the Office of the County Clerk of Hancock County, West Virginia; thence, with the common line of Hindmans Lane and Lots 6, 5, and 4 Woodlands Estates Subdivision, North 57 deg. 59 min. East 375 feet to an iron pin, found, at the common southern corner of Lots 3 and 4, said iron pins being the control and basis of bearings of the following description: Thence with the common line of Hindmans Lane and Lot 3, Woodland Estates Subdivision, North 57 deg. 59 min. East 125 feet the common corner of Lots 2 and 3; thence with the common line of Hindmans Lane and Lot 2, Woodland Estates Subdivision, North 57 deg. 59 min. 113.05 feet to the common corner of Lots 2 and 1; thence, leaving Hindmans Lane and with the common line of Lots 1 and 2, North 22 deg. 33 min. 37 sec. East 180.50 feet to the common western corner of the lands now or formerly of Craig A. Churchill, single, as recorded in Deed Book 219 at Page 48, and the lands now or formerly of Ronald D. Lamp and Barbara J. Lamp, his wife, as recorded in Deed Book 224 at Page 357; thence, with common line of Lamp and Churchill, and through Lot 1, South 88 deg. 53 min. West 17.39 feet to a 5/8 ” rebar, set, said rebar being the true place of beginning of the parcel herein described; THENCE, through Lot 1, North 26 deg. 15 min. 32 sec. West 111.93 feet to the common northern corner of Lots 1 and 2, passing on line at plus 157.95 feet a 5/8 ” rebar, set, said line being approximately 5.00 feet from the western line of an existing block garage on Lot 1; THENCE, North 46 deg. 46 min. 44 sec. East 11.93 feet to the northeast corner of Lot 1; THENCE, with the eastern line of Lot 1, South 27 deg. 44 min. East 263.64 feet to a 5/8 ” rebar, set at the common eastern corner of the lands of Lamp and Churchill, passing on line a 5/8 ” rebar, set, at plus 18.78 feet; THENCE, with the common line of Lamp and Churchill, North 88 deg. 53 min. West 128.21 feet to the place of beginning, containing 24009 square feet, more or less. Excepting and reserving a right of way, 35 feet in width, across the northern portion of Lot 1, for ingress and egress to Cove Road, County Road 507 for Lot 2. A right of way, 30 feet in width, for ingress and egress to Cove Road, County Road 507 is granted across the lands now or formerly of Barbara J. PARCEL 4
All of that certain tract or parcel of land being a part of Lot No. Two (2) of the ” Woodlands Estates Subdivision No. 1, ” situate in the District of Butler, County of Hancock and State of West Virginia, more particularly described as follows: Beginning at a point on the north side of a forty (40) foot street known as Hindman Lane, being the southwest corner of Lot No. Two (2) running thence along the westerly line of said Lot No. Two (2) N. 19 degrees 57′ 51″ W. for a distance of 182.14 feet to a point, which point is the true beginning of parcel to be conveyed; thence N. 19 degrees 57′ 51″ W. for a distance of 51.66 feet to a point; thence N. 64 degrees 48′ E. for a distance of 101.03 feet to a point on the east side of said Lot No. Two (2); thence along said east side S. 22 degrees 33′ 41″ E. for a distance of 63.48 feet to a point, thence S 71 degrees 26′ 17″ W for a distance of 103.51 feet to the place of the true beginning.
AND BEING the same real estate conveyed unto Monica N. Nelson by Deed dated the 26th day of March, 2022, from Michael P. Kerin, Executor of the Estate of William Kerin, and recorded in the Office of the Clerk of the County Commission of Hancock County, West Virginia, in Deed Book 885, at Page 2098.
TERMS OF SALE:
1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-1.
3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
