Separate sealed Bids for the Existing Water System Renovations for the Town of Pineville, Existing Water System Renovations for the Town of Pineville will be upgraded as follows: new radio read meters for all customers, New trailer and mini excavator, the repair or replace approximately 25 fire hydrants, install 4 master meters for water accountability, and the replacement of existing 6” line with new 10” line from downtown Pineville toward booster station site on WV Rt 97., will be received by Aaron Hatfield, Mayor, at the office of Town of Pineville, 75 Main Avenue, Pineville, WV 24874, until 2:00 P.M., local prevailing time, on September 16, 2025, and then at said office publicly opened and read aloud. Copies of the Contract Documents (electronic and/or hard copy) are available for purchase through TRASCO at http://www.trascoplanroom.com for an estimated $200.00 per set.

A mandatory Pre-Bid Conference will be held on August 26, 2025, 2025 at 2:00 P.M. All interested parties are requested to meet the Engineer at Pineville Town Hall, 75 Main Avenue, Pineville, WV 24874 at that time.

Any Bidder must give notice in writing of its claim of right to withdraw its Bid within two business days after the conclusion of the Bid Opening Procedure. If a Bid is withdrawn, the next higher Bidder shall be deemed to be the Low Bidder. No Bid may be withdrawn unless said withdrawal is permitted by law.

Bids must be accompanied by Bid security as specified in the Instructions to Bidders.

Bidders and Contractors performing work under this advertisement are bound by the requirements of President’s Executive Order 11246 as amended by Executive Order 11375; Title VI of the Civil Rights Act of 1964; Section 109 of Title I of the Housing and Community Development Act of 1974, as amended; the Immigration Reform and Control Act of 1986; the Davis-Bacon Act; the Copeland “Anti-Kickback” Act; the Contract Work Hours and Safety Standards Act; and Public Law 100 202.

AMERICAN IRON AND STEEL REQUIREMENT
P.L. 113-76, Consolidated Appropriations Act, 2014 (Act), includes an “American Iron and Steel (AIS)” requirement in section 436 that requires Clean Water State Revolving Loan Fund (CWSRF) and Drinking Water State Revolving Loan Fund (DWSRF) assistance recipients to use iron and steel products that are produced in the United States for projects for the construction, alteration, maintenance, or repair of a public water system or treatment works.

A five percent (5%) BID BOND must accompany all BIDS.

All Bidders are required to have a West Virginia Contractor’s License per Section§ 30-42-12 of the West Virginia Code.

No BIDDER may withdraw their bid for a period of ninety (90) days after the time of the opening of the Bids.

WV Alcohol and Drug Free Workplace Act
West Virginia code 21-1d-5 provides that any solicitation for a public improvement construction contract requires each vendor that submits a bid for the work to submit at the same time an affidavit of compliance with the bid. The enclosed drug-free workplace affidavit must be signed and submitted in the first envelope as evidence of the vendor’s compliance with the provisions of article 1d, chapter 21 of the West Virginia code. Failure to submit the signed drug-free workplace affidavit in the first envelope shall result in disqualification of such bid.

BIDDERS must comply with Title VI of the Civil Rights Act of 1964, the Davis-Bacon Wage Rates, the Copeland Anti-Kickback Act, and the Contract Work Hours and Safety Standards Act.

NON-DISCRIMINATION IN EMPLOYMENT
“Bidders on this work will be required to comply with the President’s Executive Order No. 11246. The requirements for bidders and contractors under this order are explained in the specifications.”

SUSPENSION AND DEBARMENT
Recipient shall not entertain the use of businesses that are listed on the “System for Award Management (SAM)” at www.sam.gov in accordance with 2 CFR Part 1532 and Subpart B and C of 2 CFR Part 180.

TWO ENVELOPE SYSTEM
The bid opening procedure shall be a two envelope system. The system shall consist of two separate and distinct envelopes each with proper identification. The first envelope shall be identified as “Bid Opening Requirements” and the second as “Bid Proposal”. Both shall be submitted in a single, large envelope, labeled with the contractor’s name, address, and name of the project with the contract number. The first envelope shall contain the following items complete as shown in the following checklist.

The second envelope (“Bid Proposal”) shall consist solely of the bid forms.
In the event that all of the items are not complete on the Checklist from the first envelope, the second envelope shall not be opened. The bidder will be declared non-responsive. The lowest responsive bidder shall be the bidder who has completed all of the requirements for the first envelope and has the lowest total on the bid form.
A Bid must be received no later than the date and time prescribed and at the place indicated in the Advertisement or invitation to bid and shall be enclosed in a plainly marked package with the Project title, and, if applicable, the designated portion of the Project for which the Bid is submitted, the name and address of Bidder, and must be accompanied by the Bid security and other required documents. If a Bid is sent by mail or other delivery system, the sealed envelope containing the Bid must be enclosed in a separate package plainly marked on the outside with the notation “BID ENCLOSED.” A mailed Bid must be addressed to the location designated above. Bids received after the date and time prescribed for the opening of bids, or not submitted at the correct location or in the designated manner, will not be accepted and will be returned to the Bidder unopened.

The Owner reserves the right to reject any and all Bids if it appears in its best interest to do so.

Contract time for substantial completion is 335 days and final completion is 365 days. Liquidated damages in the amount of $1,632.00 per day will be charged if not completed within the given time frame.

This project is funded by WV IJDC Loan, WV IJDC Grant, WV DEP DWTRF Design Loan, WV DEP DWTRF Principal Forgiveness Loan, Wyoming County Commission Grant, Town of Pineville Contribution, Wyoming County Commission American Rescue Plan Act Grant, and WV WDA Economic Enhancement Grant.
