The object of the above-entitled action is for violations of the City of Beckley Municipal Code of Ordinances. The Defendants, their heirs, successors, an/or assigns, are the recorded owner of the subject property. The subject property is identified on tax maps of Raleigh County in the City of Beckley District, on Map 15, as Parcel 00490000, further described as Pinecrest Add Lot 9. The property has an address of 209 Hartley Avenue, Beckley, West Virgina. Being the same property Donald D. Cook acquired on January 24, 1986 by Deed of record in the Office of the Clerk of the County Commission of Raleigh County, in Book 705, at page 278. Donald D. Cook died intestate a resident of Raleigh County, on or about June 28, 2022, leaving his daughter, Abril Dixon, as his sole heir.
It appearing by Affidavit filed in this action that the location of the Defendants heirs are unknown, or that there may be defendant(s) unknown and Defendant(s) who are nonresidents of the State for whom no agent or appointed or statutory agent or attorney in fact is found in the State upon whom service may be had to plaintiff. It is ORDERED that defendant(s), known and unknown, which may claim any interest in the above-mentioned property, appear before the Municipal Court of the City of Beckley, and Judge Matthew Fragile. It is hereby notified that on the 18th day of September, 2025, at 1:30 p.m., or as soon thereafter as counsel can be heard, the City of BeckIey, will appear before the Municipal Court of the City of Beckley, Raleigh County, West Virginia, Judge Fragile, at 169 lndustrial Drive, Beckley, West Virginia, for the further proceeding with respect to said violations of the City of Beckley Municipal Code of Ordinances.
A copy of said Complaint and Motions can be obtained from the undersigned Clerk at 169 Industrial Drive, Beckley, Raleigh County, West Virginia.
