Please take notice that the undersigned Successor Trustee does hereby give notice that on the 3rd day of October, 2025, at 11:15 a.m., he will, at the front door of the Brooke County Courthouse, Wellsburg, West Virginia, sell the following described property which was secured by a Deed of Trust dated November 6, 2014, and recorded in the Office of the Clerk of the County Commission of Brooke County, West Virginia, in Deed of Trust Book 536, at Page 715, at 10:43 p.m., wherein Kinsey F. Dulaney, Jr., an unmarried man, conveyed to Raymond A. Hinerman, as Trustee for Hancock County Savings Bank, FSB, the following described real property, to secure a Promissory Note dated November 6, 2014, in the amount of $29,250.00. Pursuant to the terms of said Notes, default having been made, the undersigned was requested in writing by the holder of the notes to conduct a sale pursuant to said Deeds of Trust:
PROPERTY TO BE SOLD:
All that certain parcel of land situate in the District of Cross Creek, Brooke County, West Virginia, being more particularly described as follows:
BEGINNING at a cross in a stone on the North side of Harmon Creek Road, said stone being at the common corner of the property conveyed and the parcel as was conveyed to Kevin D. Dulaney, et ux., by Deed of record in the Office of the Clerk of the County Commission of Brooke County in Deed Book 258, at page 67; thence leaving said road and along the East line of said Kevin D. Dulaney parcel, N. 11deg 32′ E. 100 feet to an iron pin; thence with the North line of said Kevin D. Dulaney parcel, N. 78 deg 34′ W. 61 feet to an iron pin in the Easterly line of one of the parcels as was conveyed to Donna J. Lamp by Deed of record in the Office aforesaid in Deed Book 257, at page 256; thence with the East line of said Donna J. Lamp parcel, N. 11 deg 32′ E. 91.42 feet to an iron pin; thence with the North line of said Donna J. Lamp parcel, N. 83 deg 11′ W 137.66feet to a point in the Easterly line of the parcel as was conveyed to Zane David Dulaney, et ux, by Deed of record in the Office aforesaid in Deed Book 253, at page 242; thence with the East line of said Zane David Dulaney parcel, N. 11 deg 56′ E. 219.02 feet to a point in Southerly line of the parcel as was conveyed to Starvaggi Industries, Inc., as the seventeenth parcel in the Deed of record in the Office aforesaid in Deed Book 176, at page 514; thence with the Southerly line of said Starvaggi Industries parcel, S. 55 deg 46′ E. 234.04 feet to a point in the West bank of a Run to Harmon Creek; thence with said Run and through an existing pipe witness as 2feet, S. 9 deg 38′ W 310 feet to a cross in the center line of a culvert under Harmon Creek Road; thence with the North right of way line of Harmon Creek Road, N. 76 16′ W. 29.55 feet to the place of beginning, containing 1.077 acres, more or less, all as appears from the August, 1993 Drawing No. 93-1713 as prepared by Bullock & Associates consisting of two parcels identified as “Edward W. Dulaney, 0532 acre and 0.545 acre”, hereto attached and to which reference is made for all purposes.
TERMS OF SALE: CASH
The Successor Trustee or his successor may postpone the sale of the aforesaid property by public announcement at the time and place of sale or adjourn the same from time to time.

TERMS OF SALE:
1) The Property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right to redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, right-of-ways, easements, covenants, conveyances and condition of record in the Clerk’s Office or affecting the subject property.
2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code Section 11-22-2.
3) The Purchaser shall be responsible for the payment of all unpaid real estate taxes associated with the property.
4) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
5) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
6) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate the property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
7) The total purchase price is payable to the Trustee by cashier’s check, cash or equivalent within thirty (30) days of the date of sale, with ten percent (10%) of the total purchase price payable to the trustee at sale by cashier’s check, cash or equivalent.
8) In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.
