TRUSTEE’S SALE OF
VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated June 7, 2006, and duly recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed of Trust Book 1366, at Page 63, Erica Jill Sams did convey unto Norman L. Polwell, Esq., Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Wood County Courthouse, in Parkersburg, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Clay District, Wood County, West Virginia, and more particularly described as follows:
All that certain lot, tract or parcel of land situate in the District of Clay, County of Wood, and State of West Virginia, being more particularly described as follows.

BEING all of Lot No. 345 of Community Acres Fourth Addition, as shown on a plat of record in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Plat Book 17, at page 44.

This conveyance is made subject to those certain covenants and restriction contained in the Declaration of Covenants and Restriction dated September 1, 1976, of record in the aforesaid Clerk’s Office in Deed Book 679, at page 80.

This conveyance is also made subject to all restrictive covenants set forth on the plat of subdivision of record in the aforesaid Clerk’s office in Plat Book 17, at page 44.

This conveyance is made subject to those certain rights-of-ways which are of record in the aforesaid Clerk’s Office and to which reference is here made for a more particular description to Monongalia Power Company, Hope natural Gas Company, C&P Telephone Company, and Claywood Park Water Association.

There is excepted and reserved from this conveyance a right-of-way ten feet wide over and across the above-described lot from the right-of-way line of the street on which the lot fronts to the dwelling situate on said lot for the purpose of maintaining, repairing, replacing and reconstruction the water and sanitary sewer lines which have hereto been constructed over and across said lot.

Being the same real estate conveyed to Edward N. Sams and Inella V. Sams by deed dated March 15, 1983, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 784, at page 566. Edward N. Sams departed this life on May 15, 1997, leaving the above- described property to Inella V. Sams due to survivorship language in deed. Inella V. Sams departed this life on May 23, 1997, testate, leaving her sole interest in the above-described property to Erica Jill Sams. Also being the same property conveyed unto Lou E. Morgan and Joyce A. Morgan by deed dated November 2, 1982, and of record in the aforesaid Clerk’s Office in Deed Book 777, at page 371.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 137 Spruce Street, Davisville, WV 26142.

AND BEING the same real estate which was conveyed to Edward N. Sams and Inella V. Sams, by Deed dated March 15, 1983, from Lou E. Morgan and Joyce A. Morgan, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia, in Deed Book 784, at Page 566. The same real estate was conveyed to Erica Jill Sams by the Last Will and Testament of Inella Virginia Sams, and recorded in the Office of the Clerk of the County Commission of Wood County, West Virginia in Book 111, at Page 705.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
