Application for a consolidated purchased power surcharge

NOTICE OF FILING AND EVIDENTIARY HEARING

On August 1, 2025, Black Diamond Power Company (Black Diamond) applied for revised consolidated purchased power rates, effective December 1, 2025. This proceeding is designed to consolidate the various elements of purchasing power into a single annual Commission review. Black Diamond has requested a purchased power surcharge of $0.1584715 per kwh. The proposed surcharge would result in a total annual revenue increase of approximately $643,614. Black Diamond also stated that it has accumulated a total under-collected balance of $1,241,894 for its consolidated purchased power costs.

The average monthly bill for customers will be changed as follows:

The increases shown are based on averages of all customers in the indicated classes. Individual customers may receive increases that are greater or less than average. Furthermore, the requested increased rates and charges are only a proposal and are subject to change (increases or decreases) by the Public Service Commission in its review of this filing. Any change in rates and charges will not become effective until authorized and approved by the Public Service Commission.

This procedure for revising consolidated purchased power rates is designed to provide a procedure for changing rates charged to customers of Black Diamond based exclusively on the costs of purchased power. Consequently, protests should be limited to the reasonableness of such costs and the method by which they are calculated.

Anyone desiring to intervene should file a written petition to intervene within ten (10) days following the publication of this notice. Anyone desiring to file a public comment or protest may file written comments by US Mail addressed to Executive Secretary, Public Service Commission of West Virginia, P.O. Box 812, Charleston, WV 25323 or electronically at http://www.psc.state.wv.us. All comments and petitions to intervene should reference Case No. 25-0702-E-P. Failure to timely intervene can affect your rights to participate in future proceedings.

The matter is scheduled for two public comment hearings. One public comment hearing is scheduled to take place in Clay, at 5:30 p.m., October 14, 2025 Clay County Courthouse, Circuit Courtroom, 246 Main St., Clay, WV. The second public comment hearing is scheduled for 5:30 p.m., October 21, 2025, Mullens City Hall, Council Chambers, 316 Moran Ave., Mullens WV.

This matter is also scheduled for an evidentiary hearing on October 31, 2025, at 9:30 a.m. at the headquarters of the Public Service Commission, 201 Brooks Street, Charleston, WV 25301. The Commission may cancel the hearing for good cause shown. Interested persons intending to attend the evidentiary hearing should monitor the Commission web docket for updated information.
