TRUSTEE’S SALE OF VALUABLE REAL ESTATE NOTICE OF TRUSTEE’S SALE is hereby given pursuant and by virtue of the authority vested in the Substitute Trustee, C. William Harmison, Harmison & Associates, PLLC, by that certain Deed of Trust executed by Peter Booth unto Charles S. Trump IV or George I. McVey, Trustees to secure Robert L. Sloan and Janet R. Sloan, the beneficial owners of that certain Deed of Trust dated the 16th day of September, 2022, of record in the office of the Clerk of the County Commission Morgan County, West Virginia, in Deed of Trust Book No. 491, at Page 99. Default having occurred relative to the covenants and conditions as set forth in said Deed of Trust, and the undersigned Trustee, having been instructed in writing by the beneficial owners so to do, will office the hereinafter described real estate for sale at public auction to the highest responsible bidder at the front door of the Courthouse in Berkeley Springs, Morgan County, West Virginia, on the following date: Wednesday, December 3rd, 2025 at 10:00 A.M. All that certain tract or parcel of real estate, together with all the rights, rights of way, easements, privileges, improvements and appurtenances thereunto belonging, situate in Bath District, Morgan County, West Virginia, and being more particularly described follows: PARCEL ONE: BEING LOT NUMBERED ONE, (1), as designated on the Plat of Prospect Peak Subdivision, which plat is of record in the Office of the Clerk of the County Court of Morgan County, West Virginia, in Map Book No. 2, at page 57. TOGETHER WITH A TWENTY FOUR (24) FOOT WIDE NON-EXCLUSIVE RIGHT-OF-WAY, for access, running from State Route No. 9 in a southwesterly direction over the northwest portions of Lots No. 2 to 13 inclusive, as shown on said plat of Prospect Peak Subdivision. TOGETHER WITH the non-exclusive right to obtain water for domestic purposes from a water system, containing a reservoir water tank on said subdivision, from which a water pipeline runs northerly through the Prospect Peak Subdivision, across that tract of 30.446 acres, conveyed from Edward L. Niner and Eleanor M. Niner, husband and wife, to Kenneth C. Dawson, by deed dated 23 June, 1972, of record in the said Clerk’s Office in Deed Book No. 83, at page 282, and to a well and pumping station situate on a parcel of 0.125 acres, conveyed to Kenneth C. Dawson in Deed Book No. 82, at page 533. PARCEL TWO: BEING LOT NUMBERED TWO (2) as designated on the Plat of Prospect Peak Subdivision, which plat is of record in the Office of the Clerk of the County Court of Morgan County, West Virginia, in Map Book No. 2, at page 57. THERE IS EXCEPTED AND RESERVED an easement for a water reservoir, with water pipelines and electric lines running to and from said reservoirs for the purpose of finishing water to all lots within the Prospect Peak Subdivision and other lands of Kenneth C. Dawson and Annalea V. Dawson. Said easement is more particularly described in that certain deed from Kenneth C. Dawson and Annalea V. Dawson, husband and wife, to Charles M. Clutterbuck and Mary Jane Clutterbuck, of record in the said Clerk’s Office in Deed Book No. 85, page 663. TOGETHER WITH AND SUBJECT TO A TWENTY FOUR (24) FOOT WIDE NON-EXCLUSIVE RIGHT-OF-WAY, for access, running from State Route No. 9 in a southwesterly direction over the northwest sides of Lots No. 8 to 13 inclusive, and through Lots Nos 2 to 7 inclusive, as shown on said plat of Prospect Peak Subdivision. TOGETHER WITH non-exclusive right to obtain water for domestic purposes, from a water system, containing a reservoir water tank on said subdivision, from which a water pipeline runs northerly through the Prospect Peak Subdivision, across that tract of 30.446 acres, conveyed from Edward L. Niner and Eleanor M. SUBJECT TO those covenants and restrictions of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book No. 85, at page 57. THIS CONVEYANCE IS FURTHER SUBJECT TO all public utility easements, rights-of-way, conditions, covenants and restrictions of record or in existence. AND BEING the same real estate granted and conveyed from Robert L. Sloan and Janet R. Sloan unto said Peter Booth, by deed bearing date the 16th day of September, 2022, of record in the office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book No. 288, at page 581. It is the intention of this notice to sell the secured property by proper description as was intended to be transferred and conveyed in the aforesaid deed of trust. The above described real estate in reported to having a mailing address of: 400 Prospect Peak, Berkeley Springs, WV 25411. TERMS OF SALE 1) The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the aforesaid Clerk’s Office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by West Virginia Code § 11-21-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) Terms of the sale are 10 percent in cash, certified check or other form acceptable to the Trustee to be paid on day of sale, and the balance to be paid by certified or cashiers check within 30 days of the date of the sale.
