NOTICE OF TRUSTEE'S SALE

The undersigned Substitute Trustee, by virtue of the authority vested in her by that certain Deed of Trust executed by and between DAVID B. GOMEZ, ("Borrower"), and ALAN R. TERRY and CARL W. ROOP (First Trustees), and PIONEER COMMUNITY BANK, INC., ("Lender"), dated the 8th day of November, 2017, and of record in the Office of the Clerk of the Raleigh County Commission in Raleigh County, West Virginia, in Trust Deed Book 5066, at Page 5655. Whereas, said Lender having nominated and appointed ANNA R. ZIEGLER, ROBERT A. GARDNER, DAVID L. ZIEGLER, and the law firm of Ziegler & Ziegler, L.C., any one of whom may act, ("Substitute Trustees"), by Substitution of Trustee dated August 29, 2025, and of record in the aforesaid Clerk's Office in Book 5086 at Page 4385. Said Deed of Trust being presently in default, the said Substitute Trustees having been requested by the beneficiary thereof so to do, NOW, THEREFORE, we, ANNA R. ZIEGLER, ROBERT A. GARDNER, DAVID L. ZIEGLER, and the law firm of Ziegler & Ziegler, L.C., Substitute Trustees as aforesaid, will proceed to sell the hereafter described real estate at public auction on the 3rd day of December, 2025, at the hour of 11:15 a.m., to the highest bidder for cash in hand, 10% down the day of the auction, remainder due within 30 days of the sale, at the front door of the Courthouse of Raleigh County, West Virginia, which real estate is located in the Town District, Raleigh County, West Virginia, and is more particularly described as follows::

TRACT NO 1:

Part of Lot No. 24 of Section No. Ten (10) of the said Town of Crab Orchard, as the same is shown and designated on a map of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 99 at Page 122.

And Lot No. 24 fronting 50.11 feet on the New State Highway and extending back with Lot No. 23, 94.05 feet to an alley and extending back on opposite side 90.72 feet to said alley and bordering thereon 50 feet.

TRACT NO. 2:

Part of Lot No. 25, Section 10 of the Town of Crab Orchard, Raleigh County, West Virginia, as shown by map thereof, incorporated in a deed from Lilly Land Company to Alva A. Turner, dated July 18, 1928, in Deed Book No. 99 at Page 112.
The part of Lot 25, hereby conveyed is described as follows: said Lot fronts 50.11 feet on New State Highways Route #12, and extends back therefrom with Lot 24, a distance of 90.72 feet to an alley, and back on opposite side with Lot No. 26, a distance of 86.8 feet to said alley and bordering thereon 50 feet, as shown on map in Map Book 8, at Page 112.

TRACT NO. 3:

The surface of certain lots or parcels of land situated in Town District, Raleigh County, West Virginia, and being: Lot No. 26, Section Ten (10) of the Town of Crab Orchard, as shown on a map of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 99 at Page 112.
Said lot fronts fifty and twelve-hundredths (50.12) feet on the new State Highway and extends back with Lot No.25, eighty-six and eight-tenths (86.8) feet to an alley and extends back on the opposite side Eighty-One and Six-Tenths (81.6) feet to said alley, bordering thereon Fifty (50) feet.
There is expressly reserved from this conveyance that portion of Lot No. 26 which was conveyed to the County Court of Raleigh County, West Virginia, by deed dated August 28, 1931. Also, the mineral and mining rights heretofore conveyed by predecessors in title. Residence or other buildings of value of less than $1,000.00 shall not be erected on this lot. See Deed Book 195 at Page 109 in the Office of the Clerk of the County Commission of Raleigh County, West Virginia.

AND BEING the same property conveyed unto David B. Gomez from Pamela Gomez, by deed dated July 13, 2011, and of record in the Office of the Clerk of the Raleigh County Commission in Deed Book 5043 at Page 8502.

THIS SALE IS MADE subject to such easements, rights-of-ways, restrictive covenants, reservations and agreements as are contained and set forth in prior deeds of conveyance pertaining to said real estate.

SAID SALE SHALL BE SUBJECT TO THE FOLLOWING
CONDITIONS:
1) 10% of the successful bid shall be paid by the successful bidder unto the Substitute Trustee(s) the day of sale, by cash or certified funds. The balance of said bid shall be due via certified funds unto the Substitute Trustee(s) within 30 days of the sale.

2) Subject to any and all mineral rights and reservations, stipulations, restrictions, reservations, easements, conditions and covenants contained in all former conveyances of the subject property or appearing of record in the aforesaid Clerk's Office except any pertaining to race, color or creed.

3) Subject to all real estate taxes against said property and any taxes which constitute a lien upon the said property but which are not yet due and payable.

4) The subject property will be sold in AS IS condition. The trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

5) The property will be conveyed by the undersigned Trustee to the purchaser without warranty of any kind, expressed or implied.

6) The aforesaid sale may be adjourned from time to time as the undersigned Trustee deems advisable, which adjournment may be made by oral proclamation at the time and place of the sale or any adjournment thereof.
