TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated August 1, 2011, and duly recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Document No. 2011012590, in Book No. 00879, at Page 00537, Georgia Fisher did convey unto Richard A. Pill, Esq, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 04, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Wells Fargo Bank, N.A. to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on November 5, 2015 at 11:00 a.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Oak Hill District, Fayette County, West Virginia, and more particularly described as follows: The following described tract or parcel of real estate, together with any improvements thereon, rights incidental thereto and any appurtenances thereunto belonging, situate in the City of Oak Hill, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: BEGINNING at a point in the northern line of Lot No. 29 of the Trump Addition to said City, said point being at the common back corner of Lots 66 and 67; thence leaving Lot 29 and with the common line between Lots 66 and 67, N 49-32 W 150 feet to a point in the southern edge of Sanford Street; thence with said Street S 40-28 W 50 feet to the intersection of Trump Avenue with said street; thence leaving the Street and with the Avenue S 26-35 W 150 feet to a point in line of Lot 66 and leaving the Avenue and through Lot 66 about N 46-30 E 113.7 feet, more or less, to the point of beginning. Being a part of Lot No. 66 of the Trump Addition to said City of Oak Hill as the same is shown on a certain map thereof which is of record in the Office of the Clerk of the County Court of Fayette County, West Virginia, in Map Book 4 at page 335, to which said map reference is here made for a further and more particular description of the parcel of real estate hereby conveyed. There is, however, excepted and reserved from the above-described real estate that certain portion thereof which was conveyed unto Hughie E. Jones by Deed of James L. Ingram and Katherine H. Ingram, his wife, dated March 13, 1972, and of record in the Office of the Clerk of the County Commission of Fayette County, West Virginia, in Deed Book 301 at page 470. And being the same real estate which was conveyed unto George Fisher by Deed of Vincent Dixon, et als, dated the 1st day of August, 2011, and to be recorded in the Office of the Clerk of the County Commission of Fayette County, West Virginia, prior to or simultaneously with the recordation of this instrument. This deed of trust is made and accepted subject to all validly continuing reservations, restrictions, conditions, covenants, easements and rights of ways made and contained in all prior deeds in the chain of title to the above-described property. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 162 Trump Avenue, Oak Hill, WV 25901. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS: $9,000.00 in cash and/or certified funds as deposit with the balance due and payable within 30 days of the day of sale. FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer. Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
