Swisher, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Jackson County Courthouse, in Ripley, West Virginia, on January 21, 2026, at 1:52 PM The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Ripley Town District, Jackson County, West Virginia, and more particularly described as follows: All that certain lot, tract, or parcel of real estate situate, lying, and being in Robinson Heights Addition, City of Ripley, Jackson County, West Virginia, more particularly bounded and described as follows: BEGINNING at an iron pin set at the southeastern corner of a lot presently owned by Ernest H. and Gladys Wine; thence S. 73 deg. 33′ 56″ E. 21.56 feet to an iron pin set on the western right of way of the street; thence with the said right of way S. 3 deg. 56′ 54″ W. 115.89 feet to an iron pin; S. 19 deg. 50′ 35″ W. 123.42 feet to an iron pin; S. 19 deg. 50′ 35″ W. 123.42 feet to an iron pin; S. 02 deg. 48′ 29″ E. to an iron pin set at the juncture of the street and an easement 24 feet in width for ingress and egress to Lot No. 2; thence with the northern right of way of said easement S. 70 deg. 20′ 59″ W. 178.10 feet to an iron pin; thence with the division line of Lots 1 and 2, N. 29 deg. 45′ 10″ W. 211.36 feet to an iron pin; thence N. 57 deg. 33′ 48″ E. 353.13 feet to the place of beginning, containing 1.51 acres, more or less, and being Lot No. 1 of the Cedar Ridge Development Subdivision. The real estate herein conveyed is the same real estate conveyed unto Richard K. Harmon, husband and wife, as joint tenants with the right of survivorship, by Cedar Ridge Development, a partnership, by deed dated August 22, 1979, of record in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 241, Page 493. Richard K. Harmon is now deceased and by operation of law the above described real estate vested in Alice Faye Harmon, one and the same person is Alice Faye Milhoan. Thereafter, by deed dated June 20, 2016, of record in the aforesaid Clerk’s Office in Deed Book 467, page 969, Alice Faye Harmon Milhoan conveyed the above described real estate unto Joshua R. Parsons and Destiny V. Parsons, husband and wife. Thereafter, by deed dated August 7, 2018, of record in the aforesaid Clerk’s Office in Deed Book 504, page 266, Joshua R. Parsons and Destiny V. Parsons conveyed the above described real estate unto Melissa Sue Morris and Earl B. Cooper. Thereafter, by deed dated June 17, 2020, of record in the aforesaid Clerk’s Office in Deed Book 528, page 676, Melissa Sue Morris and Earl B. Cooper conveyed the above described real estate unto Melissa Sue Morris. Thereafter, by deed dated April 22, 2022, not yet of record in the aforesaid Clerk’s Office, but to be recorded simultaneously herewith, Melissa Sue Morris conveyed the above described real estate unto Woodrow White and Emily White, husband and wife. There is hereby RESERVED and EXCEPTED from this conveyance all of the oil, gas, and minerals underlying this subject acreage. This conveyance is made subject to all reservations of minerals, all easements, and rights of way of record and to the protective and restrictive covenants of said Robinson Heights Addition as set out in Map Book No. 2, page 93. It is understood and agreed that in no event will the grantors, their heirs, and/or assigns clear and/or remove timber from more than forty (40%) per cent of the lands herein conveyed. There is hereby RESERVED and EXCEPTED a sewer easement ten feet in width over and across the northern end of the lot herein conveyed for the benefit of Lot A. By agreement dated January 16, 1990, of record in Deed Book 287, page 193, Alice Faye Harmon, single, conveyed all of her right, title and interest in and to that certain utility easement located between lots 2 and 3 of the aforesaid subdivision unto Prasid Vongsnakorn and Urai Vongsnakorn, his wife. This conveyance is made subject to that certain Shared Driveway Agreement dated June 22, 2018, of record in the aforesaid Clerk’s Office in Miscellaneous Book 25, page 211, by and between Urai Vongsnakorn and Joshua R. Parsons and Destiny V. Parsons. This conveyance is made subject to all oil, gas, and other mineral reservations as made by predecessors in the chain of title and to all valid and existing rights of way and easements. AND BEING the same real estate which was conveyed to Woodrow White and Emily White, by Deed dated April 22, 2022, from Melissa Sue Morris, and recorded in the Office of the Clerk of the County Commission of Jackson County, West Virginia, in Deed Book 543, at Page 286. The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
