NOTICE OF SUCCESSOR TRUSTEE’S SALE Notice is hereby given that default having occurred in the payment of that certain indebtedness secured by a deed of trust dated May 8, 2020 between Kenneth W. Hutchinson and C. William Harmison, Trustee, recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed of Trust Book No. 451, at page 17; which deed of trust authorizes the beneficial owner to remove and appoint a Successor Trustee to act in person, or by agent, at its option, and the beneficial owner exercised such option and appointed Nelson M. Michael as its Successor Trustee to act in the enforcement of said deed of trust in person, or by agent, and the undersigned Successor Trustee having been requested in writing by the beneficial owner of said indebtedness to enforce said deed of trust, will sell at public auction to the highest bidder the following hereinafter described real estate on THURSDAY, JANUARY 29, 2026 AT 12:00 O’CLOCK, P.M IN FRONT OF THE MORGAN COUNTY COURTHOUSE, 77 FAIRFAX STREET BERKLEY SPRINGS, WEST VIRGINIA 25411 All of the following described real estate, together with all the rights, improvements, privileges, rights of way and appurtenances thereunto or in anywise appertaining, situate in Cacapon District, Morgan County, West Virginia, more particularly described as follows: PARCEL NUMBER ONE TRACT NUMBER ELEVEN (11) OF THE RED BARN SUBDIVISION, a plat of said subdivision of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Map Book No. 3 at page 113, together with all rights, right-of-ways, easements and appurtenances thereunto belonging. THIS CONVEYANCE is subject to all of the restrictive covenants of record in the Office of the Clerk of the County Commission of Morgan County, West Virginia, in Deed Book 100 at page 487. There is conveyed with this property a right-of-way as shown on the plat of Red Barn Subdivision, which right -of-way is 50 feet wide with 25 feet thereof being within the bounds of the tract herein conveyed, and there is also reserved said right-of-way as an open road across part of the tract herein conveyed for the use and benefit of the grantees ad grantor, its successors and assigns or other tract owners who have the right to use the same; it being understood that the present roadway in located within the bounds of fifty (50) foot right-of-way as shown on the said plat, but may not necessarily be located in the center thereof. PARCEL NUMBER TWO “BEGINNING, at (1) large marked white oak tree corner to Bradley and Junior Michael, the second corner of the original tract, thence with the second line of the original tract, and Michael, North 82 West 1320.00 feet to (2) iron stake, in the original line, thence leaving said line, South 08 West 330.00 feet to (3) an iron stake; thence parallel to the first line, South 82 East 1261.8 feet to (4) an iron rod, on the East side of the County Road, in the first line of the original survey, thence with said line, crossing the County Road, North 18 East 335.1 feet to the beginning, containing 9.78 acres, acres, according to a survey and plat made by W. Thomas Biggert, Surveyor, on November 1, 1967, a copy of which Pat is recorded in the Office of the Clerk of the County Commission of Morgan County, West Virginia in Deed Book 74, at page 149.” EXCEPTING AND RESERVING from the above described real estate that 2.00 acre conveyance from Susan C. Mann unto Kiera L. Mann, et al., by Transfer on Death Deed of even date herewith of record in the aforesaid Morgan County Clerk’s office. The above described real estate will be conveyed by the undersigned Substitute Trustee by deed without warranty of any kind, express or implied, and subject to all prior liens, and further subject to all unpaid real estate taxes or assessments, encumbrances and claims in favor of public service district/municipal sanitary boards, if any, and also further subject to any covenants, restrictions, conditions, reservations, rights of way and easements of record in the aforesaid Clerk’s office and affecting the subject real estate and without responsibility for or representations as to any items of personal property located thereon; and, any party claiming an interest in any item of personal property is responsible for the removal thereof prior to the day of sale. The property will be sold in its present condition “AS IS”. The undersigned Substitute Trustee makes no warranties as to the condition of the premises. Said Substitute Trustee shall be under no duty to cause any tenant or other persons occupying the premises to vacate same. All net proceeds of sale shall be first applied to the satisfaction of the aforesaid first lien deed of trust. TERMS OF SALE 1. Ten percent (10%) NON-REFUNDABLE deposit on day of sale; balance within 30 days; 2. Subject to any prior deeds of trust or security agreements of record; 3. Subject to any special assessments or any liens for taxes; 4. The above described real estate will be sold by the undersigned Trustee by auction to the highest bidder subject to the right of the undersigned Trustee to eject all bids if, in his opinion, said bids are inadequate; 5. The owner of the indebtedness secured by the above described deed of trust shall have the right to bid. 6. Buyer shall be responsible for payment of all recording fees and transfer tax. 7. Real estate taxes will be pro-rated at the time of settlement CONTINUANCE OR ADJOURNMENT OF SALE The undersigned Trustee reserves the right to continue the sale or to adjourn the sale for a time or from time to time without further notice other than oral public announcement at the time and the place of sale as hereinabove set forth or at any continuance or adjournment thereof.
