NOTICE OF TRUSTEE’S SALE NOTICE OF TRUSTEE’S SALE is hereby given pursuant to and by virtue of the authority vested in the Trustee, Richard A. Pill, by that certain Deed of Trust dated August 4, 2020, executed by Borrower(s), Tracey M. Stewart, to Richard A. Pill, the Trustee of record in the office of the Clerk of the County Commission of Mineral County, West Virginia, in Book 605, at Page 521. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 326 Cottage Grove Ln, Fort Ashby, WV 26719. The borrower(s) defaulted under the Note and Deed of Trust and the Trustee has been instructed to foreclose under the Deed of Trust. Accordingly, the Trustee will sell the following described property to the highest bidder at the front door of the Courthouse of Mineral County, in Keyser, West Virginia, on the following date: February 9, 2026, at 9:00 a.m. All those two tracts or parcels of real estate situate in Frankfort District, Mineral County, West Virginia, more particularly described as follows: FIRST: All that certain lot or parcel of land lying and being situate in Frankfort District, Mineral County, West Virginia, and known and numbered on the Map of the M. H. Martin Riverside Addition to Fort Ashby, West Virginia, as Lot No. 3, which said lot is bounded and described as follows: BEGINNING at a stake located South 54 degrees 15 minutes West 180 feet from the center of a large hickory tree, second corner to Lot No. 2 in said Riverside Addition, and running thence across the original tract South 54 degrees 15 minutes West 100 feet to a stake, beginning corner to Lot No. 4 in said Addition; thence reversing the last line of said Lot No. 4 North 35 degrees west 241.67 feet to a point in Patterson`s Creek in the seventh original line; thence down said Creek and with a portion of said original line North 52 degrees 13 minutes East 100.1 feet to a point in said Creek, corner to Lot No. 2 in said Addition; thence reversing the second line of said Lot No. 2 South 35 degrees East 245.21 feet to the beginning. Said First Parcel is depicted on the 2020 Mineral County Land Records as District 04, Tax Map 31B, Parcel 12. SECOND: All that certain lot or parcel of real estate located in Frankfort District, Mineral County, West Virginia, and being located near the town of Fort Ashby, West Virginia, which was the subject of a survey by George Heavener, dated August 14, 1963, and wherein the said lot or parcel of land is more particularly described as follows: Beginning at a stake on south side of a road, corner of Lot #3 and #2 of Riverside Addition to Forth Ashby, West Virginia, thence S 35 E 150` to a stake; then S 54 15` w 100 feet to a stake; thence N 35 W 150 feet to a stake on the South side of a road, corner of lot #3 and lot #4 of Riverside Addition; thence with original line of said addition, reversed N 54 15` E 10.0 feet to the beginning; containing 15,000 square feet more or less. Said Second Parcel is depicted on the 2020 Mineral County Land Records of District 04, Tax Map 31B, Parcel 25. And being the same parcels of real estate which were conveyed unto Tracey M. Stewart, by deed of Christopher M. Collett, Brian G. Collett and Kathleen A. Luzier, Heirs of Nora Egan Collett, by deed dated July 23, 2020, and to be recorded prior to or contemporaneously with the recordation of this instrument in the Office of the Clerk of the County Commission of Mineral County, West Virginia TOGETHER WITH AND SUBJECT TO that certain paragraph that appears in the deed of conveyance from Melvin H, Martin and Tempest L. Martin, his wife, unto Charles L. McCracken and Edythe B. McCracken, his wife, by deed dated November 13, 1945, of record in said Clerk`s Office in Deed Book 80, at page 218: “It is agreed between the parties hereto, and is a condition precedent to the acceptance of this deed, that the front twenty (20) feet of the lot hereby conveyed shall be used as a public road, as is shown on the plat of said “Riverside Addition”, for the benefit of the owners of the lot hereby conveyed and the owners of the other lots in said “Riverside Addition”.” TERMS OF SALE: 1) The property will be conveyed in an “AS IS” physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property. 2) The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code 11-22-1. 3) The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale. 4) The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee. 5) The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY. 6) The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
