NOTICE OF TRUSTEE SALE NOTICE IS HEREBY GIVEN that, default having been made in the payment of the indebtedness secured by the deed of trust hereinafter described, and the undersigned Substitute Trustee (see Book No. 5059, at page 9005) will offer for sale, at the front door of the Raleigh County Courthouse, Beckley, West Virginia, on December 17, 2015, at 12:30 o’clock in the after / forenoon, local time, at public auction, to the highest bidder for cash, all of the right, title and interest of James R. Kessinger, in and to the real property described in a certain Deed of Trust dated July 31, 2011, to Metz Law Offices, PLLC, original Trustees, recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Book No. 5045, at page 7126 thereof, possessed by the said James R. Kessinger as at the making of said deed of trust, which real estate conveyed by said maker is described as follows, to wit: Situate in the City of Beckley, County of Raleigh and State of West Virginia, being more particularly being the major portion of Lot No. 37 of Home Addition to said City, a map of said addition being of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 62, at page 68, which property is more particularly described as follows: BEGINNING at a point on the sidewalk lying on the North side of East Prince Street, said point N. 78 f 54′ W. 60.79 feet from the West line of Scott Avenue, said point in the common line of Lots Nos. 37 and 38 of the Home Addition; thence N. 15 f 41′ E. And along said common line a distance of 143.45 feet to a stake in the South line of a 10-foot alley; thence N. 76 f 33′ W. And along said alley line 50.04 feet to a stake, a corner to Lot No. 36; thence S. 15 f 41′ W. And along a fence line a distance of 145.55 feet to a point on the sidewalk; thence through Lot No. 37, S. 78 f 57′ E. 50.16 feet to the point of beginning. Prior Reference: Book 5021, at page 264. And believed to have a street address of 229 East Prince Street, Beckley, West Virginia. Said sale shall be upon the following terms and conditions, to-wit: 1. Cash in hand on day of sale. 2. Subject to any and all reservations, exceptions, conditions, grants of rights of way and easements made by the grantors or their predecessors in title prior to the granting of the deed of trust being foreclosed upon. 3. The undersigned reserves the right to adjourn the sale from day to day and time to time upon oral proclamation made at the time and place of sale set forth herein or at such later time and place to which the sale has theretofore been adjourned. 4. The undersigned reserves the right to reject any and all bids. 5. Sale is subject to unpaid ad valorem taxes and special assessments, if any. 6. The premises described herein above, including any and all improvements thereto, are sold “AS IS-WHERE IS” with no warranty express or implied. 7. The owner and holder of the indebtedness secured by the deed of trust described herein above reserves the right to bid at this sale. 8. The successful buyer at the sale will be responsible for paying any and all transfer stamps, excise fees and recording costs with respect to the trustee’s deed. 9. Neither the owner and holder of the indebtedness secured by the underlying deed of trust, nor the substitute trustee shall have any duty to cause any existing tenant or person or persons occupying the subject property to vacate said property. 10. Any personal belongings remaining in the subject premises after sale shall be deemed abandoned and may thereafter be disposed of at the successful bidder’s or bidders’ discretion.
