City of Hinton New River Center Project
1. General Information
The City of Hinton is requesting proposals from qualified Architectural and Engineering (A/E) firms to provide professional design services for the rehabilitation and adaptive reuse of the New River Center building (formerly known as New River Grocery or Hinton Hardwoods) , a historic structure located at the corner of 5th Avenue & Summers Street in Hinton, WV.
This project is anticipated to be funded in part with assistance from the U.S. Department of Housing and Urban Development (HUD). Procurement will be conducted in accordance with 2 CFR Part 200 (Uniform Administrative Requirements, Cost Principles, and Audit Requirements for Federal Awards), applicable HUD regulations, state and local procurement requirements, and Qualifications-Based Selection (QBS) procedures consistent with the Brooks Act (40 U.S.C. §§ 1101-1104).
2. Project Description
The New River Center, constructed circa 1910, is a historically significant structure located within the City of Hinton Historic District. The project will involve architectural and engineering design services necessary to rehabilitate the building for mixed use occupancy that includes restaurant and retail space on the first floor and market rate apartment homes on the second and third floors, while preserving its historic character and upgrading building systems to meet current codes and accessibility requirements.
**Existing Conceptual Design**
The Recipient has previously obtained conceptual-level drawings prepared by a separate firm. These materials are intended to inform the project but are **not final, not biddable, and do not establish a preferred design solution**. Respondents shall assume responsibility for verifying any existing information and for preparing all final design and construction documents necessary for bidding and build out construction. Firms shall disclose any prior involvement in the project, including preparation of conceptual designs, feasibility studies, or planning documents.
The project is subject to:
– Section 106 of the National Historic Preservation Act
– HUD Environmental Review requirements (24 CFR Part 58)
– The Secretary of the Interior's Standards for Rehabilitation
– ADA, Fair Housing Act, and applicable state and local codes
3. Scope of Services
The selected firm will provide professional architectural and engineering services including, but not limited to:
Architectural Services
-Existing conditions assessment and documentation
-Historic preservation evaluation and coordination
– Schematic Design (SD)
– Design Development (DD)
-Construction Documents (CD) suitable for bidding
Engineering Services
-Structural assessment and design
-Mechanical, Electrical, and Plumbing (MEP) design
-Fire protection and life-safety systems
-Energy efficiency and code compliance analysis
-Accessibility (ADA/FHA) compliance
Optional Services
-Assistance with permitting and regulatory approvals
-Coordination with HUD, SHPO, and other agencies
-Construction administration services (if authorized)
4. SHPO & Section 106 Milestones (Required)
The consultant shall support and coordinate compliance with Section 106 of the National Historic Preservation Act and HUD environmental review requirements, including the following milestones:
– Historic Resource Documentation
– SHPO Consultation Support
– Design Review Milestones
– Mitigation & Conditions
5. Federal & HUD Compliance Requirements
The selected firm must comply with all applicable federal and HUD requirements, including but not limited to 2 CFR 200.317-200.327 (Procurement Standards), 2 CFR Part 200, Subpart E (Cost Principles), HUD Environmental Review (24 CFR Part 58), Section 106, Conflict of Interest, Debarment and Suspension (SAM.gov registration required), Civil Rights and Equal Opportunity requirements, and record retention and audit requirements.
6. Proposal Submission Requirements
Proposals shall include firm qualifications, relevant experience, project team, technical approach, and cost proposal.
7. Evaluation Criteria
Proposals will be evaluated based on the following criteria:
– Experience with historic rehabilitation projects
– Qualifications of proposed personnel
– Technical approach and understanding of HUD and SHPO requirements
– Experience with HUD-funded projects
– Geographic location
8. Selection & Award
The Recipient will evaluate proposals and may conduct interviews utilizing qualification-based selection and not price in compliance with 2 CFR 200.323 governing A&E service procurement. Award will be made to the firm whose proposal is determined to be most advantageous, considering qualifications and technical approach in accordance with HUD and federal procurement requirements.

FEDERAL CONTRACT PROVISIONS &
CERTIFICATIONS
PART I: MANDATORY CONTRACT PROVISIONS
(2 CFR PART 200)
1. Administrative, Contractual, or Legal Remedies (Applicable to contracts > $250,000)
In the event of a breach of contract by the Contractor, [Owner/Agency Name] shall provide written notice to the Contractor. If the Contractor fails to cure the breach within [Number] days, the [Owner/Agency Name] may pursue any and all available legal or administrative remedies, including but not limited to:

The Contractor shall be paid for work performed and costs incurred up to the date of termination.

3. Equal Employment Opportunity
The Contractor shall comply with Executive Order 11246, "Equal Employment Opportunity," as amended by Executive Order 11375, and as supplemented in Department of Labor regulations (41 CFR Part 60). 4. Clean Air Act and Federal Water Pollution Control Act(Applicable to contracts > $150,000)
Contractors must comply with applicable standards and regulations under the Clean Air Act [42 U.S.C. 7401-7671q] and the Federal Water Pollution Control Act [33 U.S.C. 1251-1387]. Violations must be reported [42 U.S.C. 7401-7671q, 33 U.S.C. 1251-1387].
5. Byrd Anti-Lobbying Amendment (Applicable to contracts > $100,000)
Contractors bidding on awards of $100,000 or more must certify they have not used Federal funds for lobbying [31 U.S.C. 1352].
6. Access to Records and Audit
The Contractor must allow access to relevant records for audits by authorized parties [2 CFR 200.337].
7. Retention of Records
Records must be kept for three years after final payment and project closeout [2 CFR 200.334].
8. Rights to Inventions and Intellectual Property
The Federal awarding agency holds a royalty-free license to use copyrighted works developed under the contract [2 CFR § 200.315].
PART II: DEBARMENT & SUSPENSION
CERTIFICATION

1. Certification Regarding Debarment
The prospective Contractor certifies that neither they nor their principals are debarred, suspended, or excluded from Federal transactions, have not been convicted of fraud in public transactions within three years, are not currently charged with such offenses, and have not had public transactions terminated for cause or default within three years.
