NOTICE OF TRUSTEE'S SALE is hereby given pursuant to and by virtue of the authority vested in the Substitute Trustee, WV Trustee Services, LLC, by that certain Deed of Trust dated August 25, 2004, executed by Borrower(s), Jimmie R. Shumate and Judy A. Shumate, to Carl W. Roop, the Trustee of record in the office of the Clerk of the County Commission of Wyoming County, West Virginia, in Book 229, at Page 48. At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 10633 Poplar Gap Rd, Ravencliff, WV 25913. WV Trustee Services, LLC were appointed as Substitute Trustees by APPOINTMENT OF SUCCESSOR TRUSTEE dated January 21, 2026, of record in the Clerk's Office in Book 309, Page 58. The borrower(s) defaulted under the Note and Deed of Trust and the Substitute Trustees have been instructed to foreclose under the Deed of Trust. Description of a tract of parcel of surface land to be conveyed to Jimmie Ray Shumate and Judy Ann Shumate. Situated on Laurel Fork, Slab Fork District, Wyoming County, West Virginia.
Beginning at the Southern most corner being a steel pin on the north side of road; thence N. 38° – 04' W. 160.76 feet to a steel pin; thence N. 16° – 01' E. 138.85 feet to a steel pin; thence S. 64° – 55' E. 131.21 feet to a steel pin; thence N. 87° – 48' E. 72.61 feet to a steel pin; thence N. 74° – 33' E. 79.28 feet to a steel pin; thence S. 18° – 56' E. 121.25 feet to a steel pin; thence S. 57° – 05' W. 124.38 feet to a steel pin; thence N. 78° – 09' W. 53.05 feet to a cross on a ledge; thence S. 57° – 43' W. 106.46 feet to the beginning, containing 1.23 acres, more or less.
And being the same property acquired by Jimmie Ray Shumate and Judy Ann Shumate, by Deed dated the 22nd day of October, 1985 from Georgia-Pacific Corporation, which said Deed is of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia in Deed Book 350, at page 119.
TERMS OF SALE:
1)The property will be conveyed in an "AS IS" physical condition by Deed containing no warranty, express or implied, subject to the Internal Revenue Service right of redemption, all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights-of-ways, easements, covenants, conveyances and conditions of record in the Clerk's office or affecting the subject property.
2)The Purchaser shall be responsible for the payment of the transfer taxes imposed by the West Virginia Code § 11-22-1.
3)The Beneficiary and/or the Servicer of the Deed of Trust and Note reserve the right to submit a bid for the property at sale.
4)The Trustee reserves the right to continue sale of the subject property from time to time by written or oral proclamation, which continuance shall be in the sole discretion of the Trustee.
5)The Trustee shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
6)Pursuant to the Financial Crimes Enforcement Network's Residential Real Estate Reporting Rule (31 C.F.R. Part 1031), effective March 1, 2026, certain non-judicial foreclosure sales involving purchasers that are legal entities or trusts and that include cash consideration may be subject to federal reporting requirements. Any successful bidder that is a legal entity or trust and paying cash shall be required, as a condition of sale, to retain a licensed West Virginia attorney to conduct the closing, who shall be designated in writing as the Reporting Person responsible for all required FinCEN filings and record retention. Trustee shall not act as the Reporting Person and shall have no responsibility for compliance with FinCEN reporting requirements.
7)The total purchase price is payable to the Trustee within thirty (30) days of the date of sale, with ten (10%) of the total purchase price payable to the Trustee at sale.
