Plaintiff, Aileen N. Goldstein, as Executrix of the Estate of Melvyn M. Okeon, Deceased and as Trustee of the Melvyn M. Okeon Living Trust Dated June 26, 2013 As Amended, has filed a COMPLAINT FOR DECLARATORY JUDGMENT AND TO APPOINT SUCCESSOR TRUSTEE (“Complaint”) in the above-entitled civil action. The subject matter of the civil action and Complaint is that certain account held by Fidelity Brokerage Services, LLC doing business as Fidelity Investments (“Fidelity”) titled as follows: “Fidelity Non-
Prototype Melvyn M Okeon MD – Trustee – Melvyn M Okeon, Medical Corp Profit Sharing Trust For The Benefit Of Melvyn M Okeon” (the “Subject Fidelity Account”). The Complaint seeks an award of declaratory judgment determining as follows: that there is no current acting Successor Trustee of the “Melvyn M Okeon, Medical Corp Profit Sharing Trust For The Benefit Of Melvyn M Okeon” (the “Subject Profit Sharing Trust”) with any authority regarding the Subject Fidelity Account; that as of the death of Melvyn M. Okeon the Estate of Melvyn M. Okeon, Deceased is the sole beneficiary of the Subject Fidelity Account and the Subject Profit Sharing Trust; and that all proceeds of the Subject Fidelity Account are now properly payable to the Estate of Melvyn M. Okeon, Deceased. The Complaint further seeks an Order of Court appointing Aileen N. Goldstein as Successor Trustee of the Subject Profit Sharing Trust with sole and complete authority to administer the Subject Fidelity Account.
It appearing by Affidavit filed in this action that the whereabouts of the above named Defendants, and their unknown heirs, successors and/or assigns, if any, are unknown and/or that such individuals or entities are non-residents of the State of West Virginia; that there are or maybe persons other than those named above who are interested in the Subject Profit Sharing Trust, whose names are unknown to Plaintiff, and who are made parties to the Complaint filed in this action by the general description of unknown Defendants, and the Plaintiff having made diligent but futile efforts to locate said Defendants; it is accordingly ORDERED that each of them do appear and serve upon William Crichton VI, Lawyer, whose address is 511 28th Street, Vienna, WV 26105, an answer or other defense to the Complaint filed in this action on or before the 15th day of April, 2026, otherwise judgment by default will be taken against them at any time thereafter.
A copy of said COMPLAINT FOR DECLARATORY JUDGMENT AND TO APPOINT SUCCESSOR TRUSTEE can be obtained from the undersigned Clerk for the Circuit Court of Wood County, West Virginia at her office located at 2 Government Square, Parkersburg, Wood County, West Virginia, 26101.
