CITY OF BUCKHANNON NOTICE OF APPEAL TO ZONING BOARD OF APPEALS Notice is hereby given that CitySwitch II-A, LLC has filed with the Zoning Board of Appeals an appeal to construct a Cellular Telecommunications Tower located at 32 1/2 N. Locust Street in the City of Buckhannon. CitySwitch II-A, LLC has been denied a permit, since the application fails to meet Zoning Ordinance No. 244, Section 612, which states in part, “The height limitation of these Standards shall not apply to flag poles, church spires, belfries, domes or similar projections not used for human occupancy nor to chimneys, ventilations, sky lights, elevator shafts, water tanks, essential service facilities, bulk heads, silos, television reception and radio dishes or antennae, and other necessary mechanical and operational apparatus usually conducted above roof level,” and Zoning Ordinance No. 244, Section 605, which states in part, “Any such fences, hedges or other plantings, structures or walls violating the provisions hereof may be removed without liability for damages by direction of the City Council. Fences shall not be built with, or composed of dangerous material such as barbed wire or so as to be electrified. Height of fences shall be restricted to a maximum height of six feet (6′) on rear property lines and side property lines behind the setback requirement set forth in Section 609, otherwise fences shall be restricted to a maximum height of four feet (4′).” A Public Hearing of the Buckhannon Zoning Board of Appeals will be held on Wednesday, April 29, 2026 at 5:30 p.m. The meeting will be held in the City Council Chambers at City Hall, 70 East Main Street, Buckhannon WV.
