NOTICE OF TRUSTEE’S SALE
Notice is hereby given that by virtue of the authority under that certain deed of trust executed by Andrew Wang, to Samme L. Gee and Kristin A. Shaffer, Trustees dated August 10, 2017, and recorded in the office of the Clerk of the County Commission of Hancock County, West Virginia, in Trust Deed Book 852, at page 170, by which was conveyed to said Trustee(s) the hereinafter described real estate to secure the payment of a certain promissory note set out and described therein, and default having been made in the payment of said note, the undersigned Substitute Trustee(s) having been appointed Substitute Trustee by an Appointment of Substitute Trustee dated July 31, 2024, and having been requested in writing by the holder of said note, will sell to the highest and best bidder on May 1, 2026 at 8:30 a.m., at the front door of the courthouse of Hancock County, West Virginia, the real estate conveyed by said deed of trust and situate in Butler (now Butler Tracts) District, Hancock County, West Virginia, together with easements, improvements and appurtenances thereunto belonging, and at the time of the signing of the Deed of Trust it was reported that the address was: 33 Dominic Drive, Weirton, WV 26062 and being more particularly bounded and described therein as follows:
All that certain tract of land situate on Kings Creek, near Weirton, in Butler District, Hancock County, West Virginia, and particularly designated, bounded and described as Lot Nine (9) on the Map of Lots Surveyed for Scott Bennett, which map is of record in Plat Book 4, at page 31, in the office of the Clerk of the County Court of Hancock County, West Virginia, subject to the restrictions pertaining to such map, which restrictions are of record in Deed Book 83, at page 86, in the office of the Clerk of the County Court of Hancock County, West Virginia, which Lot Nine (9) is more particularly designated, bounded and described as follows:
Beginning at a point, which point is the East corner of Lot Eight (8) on the Map of Lots Surveyed for Scott Bennett and is also the North corner of Lot Nine (9) on the same map; thence S. 86-1/4 deg E. for a distance of 75 feet to a point, which is the East corner of Lot nine (9) and the Norther corner of Lot Ten (10) on the same map; thence S. 17-1/2 deg W, along the dividing line between Lots Nine (9) and Ten (10) for a distance of 150 feet to a point, which point is the South corner of Lot Nine (9); thence N. 86-1/4 deg W. for a distance of 75 feet to a point, which point is the West corner of Lot Nine (9) and the South corner of Lot Eight (8); thence N. 17-1/12 deg E. for a distance of 150 feet to a point, the point of beginning; being a lot of land fronting 75 feet on a 20 foot driveway and extending back, through a uniform width of 75 feet, for a distance of 150 feet; and reference is made to such map and restrictions.
Being the same property conveyed to Phillip T. Derby and Victoria M. Derby by Deed dated April 23, 2012, and of record in the office of the County Court of Hancock County, West Virginia, in Deed Book No. 243, at page 386.
And being the same property conveyed to Andrew Wang by Deed dated the 10th day of August, 2017, by Phillip T. Derby, recorded in the aforesaid Clerk’s office in Deed Book 852, at page 167.
And subject to all reservations, exceptions, restrictions and conditions as may be contained in prior deed of record and plat thereof.
This sale is made subject to any special assessments, unpaid taxes, easements, conditions, reservations and restrictions affecting the aforesaid real estate.
The property will be conveyed in an “AS IS” condition by Deed containing no warranty, express or implied, subject to all property taxes, prior Deeds, liens, reservations, encumbrances, restrictions, rights of ways, easements, covenants, conveyances and conditions of record in the Clerk’s office or affecting the subject property.
Pursuant to the terms of said deed of trust, the Substitute Trustee(s) may postpone the sale by public announcement at the time and place designated for the sale. The West Virginia Housing Development Fund or its designee may purchase the property at any sale.
The Substitute Trustees shall be under no duty to cause any existing tenant or person occupying the property to vacate said property, and any personal property and/or belongings remaining at the property after the foreclosure sale will be deemed to constitute ABANDONED PROPERTY AND WILL BE DISPOSED OF ACCORDINGLY.
TERMS OF SALE: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of the sale.
