TRUSTEE’S SALE OF VALUABLE REAL ESTATE The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated January 16, 2014, and duly recorded in the Office of the Clerk of the County Commission of Upshur County, West Virginia, in Document No. 2014000525, in Book No. 557, at Page 468 and modified by Loan Modification Agreement recorded on September 15, 2022 in Document No. 202200006134 MOD, in Book No. 655, at Page 411, Jason D Maxwell and Nichole J Maxwell did convey unto David L. Orndorff, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by The Huntington National Bank to foreclose thereunder, will offer for sale at public auction at the front door of the Upshur County Courthouse in Buckhannon, West Virginia, on June 17, 2026 at 11:00 AM the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 07 – Washington District, Upshur County, West Virginia, and more particularly described as follows: All that certain tract or parcel of land, together with the buildings and improvements thereon and the appurtenances and rights of way thereunto belonging situate in on the waters of Sand Run, in Washington District, Upshur County, West Virginia, and being more particularly bounded and described as follows: Beginning at a 5/8″ rebar with plastic cap set in the original line with The Mary Lou Fogle Living Trust (DB 433 PG 542) which bears N52 00’00″E 615.04′ from a planted stone at the fence corner to the parent tract; Thence with three (3) partition lines N51 13’53″W 138.67′ to a 5/8″ rebar with plastic cap set; Thence N43 47’04″E 187.76′ to a 5/8″ rebar with plastic cap set; Thence N03 18’54″W 67.92′ to a 5/8″ rebar with plastic cap set in the southern right of way of Upshur County Route 9; Thence with the said right of way for two (2) lines S55 10’35″E 105.42′ to a point in the right of way; Thence S56 00’36″E 122.98′ to a point in the said right of way, corner to the Mary Lou Fogle Living Trust (DB 433 PG 542); Thence with the same S52 00’00″W passing a 1″ pipe found at 12.81′, in all 261.90′ to the beginning and containing 0.923 acres, more or less, ass surveyed in April 2013 by Mark E. Bumgardner P.S. No. 1977 and shown on a plat attached hereto and made a part of this description. This being the same tract or parcel of land conveyed from Lida Kevin Hawkins and C. Jean Hawkins husband and wife, to Jason D. Maxwell and Nichole J. Maxwell, husband and wife, as joint tenants with right of survivorship, by deed dated the 6th day of January 2014, which is not yet of record in the Office of the Clerk of the County Commission of Upshur County, West Virginia but is to be recorded prior to or simultaneously with this instrument. There is expressly reserved and excepted from said property such of the coal, oil, gas and other mineral and appurtenant mining, drilling, leasing, operating, development and removal rights and privileges as have been heretofore reserved and excepted or sold and conveyed away by the parties of the first part or prior owners by deeds of record in the aforesaid Clerk’s Office, reference to which is hereby made for all pertinent purposes; however, any and all right, title and interest of first parties in and to the coal, oil, gas, and other minerals and appurtenant mining, drilling, leasing, operating, development and removal rights and privileges in, upon and underlying said property are hereby conveyed by parties of the first part to the party of the second part. This conveyance is made subject to all covenants, restrictions, rights of way and easements affecting said premises of record in said Clerk’s Office, if any, and is further made subject to such rights of way, easements and other matters which would be disclosed by a visual inspection of the premises herein conveyed. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
