The undersigned Substitute Trustee, by virtue of the authority vested in it by that certain Deed of Trust dated July 31, 2025, and duly recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed of Trust Book 1367, at Page 380, Bryce R. Bunner and Yolanda Lynn Bunner did convey unto Turn Key Title LLC, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Pill & Pill, PLLC as Substitute Trustee by a Substitution of Trustee recorded in the aforesaid Clerk's Office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Marion County Courthouse, in Fairmont, West Virginia, on

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Fairmont City Union District, Marion County, West Virginia, and more particularly described as follows:
All that certain tract or parcel of land together with the improvements thereon and the appurtenances thereunto belonging situate, lying and being on State Street, in the City of Fairmont, Union City District in Marion County, West Virginia, and bounded and described as follows:
All that certain lot or parcel of real estate, upon which there is situate a house or dwelling known as 505 State Street, in the City of Fairmont, Marion County, West Virginia, being a parcel "which extends back from State Street about 130 feet on the northern side thereof, and 158 feet on the southern side thereof," that is to say:
Beginning at a post on the eastern side of State Street, corner to lot now or formerly owned by John F. Frum and running thence with one line of said Frum, N. 58 deg. 45' E. 130 feet; thence leaving said Frum's line and running S. 45 deg. E. 50 feet to a stake, corner to lands now or formerly of William E. Means, and thence with two lines thereof S. 33 deg. 30' E. 13.5 feet to a stake; and thence S. 69 deg. 20' W. 158 feet to a post in the east side of State Street; and thence with the eastern line of said State Street, N. 13 deg. W. 36 feet to the place of beginning.
The real estate is further conveyed subject and together with the right of way for the purpose of a driveway or roadway along and near the southern edge of said real estate, which right of way or driveway is reserved for the joint use of the owner of 505 State Street, the adjoining property owners and Regina LeGamba Russell, and their heirs and assigns; and further subject to a right of way through the rear of said driveway for ingress to and egress from the property to the rear now or formerly owned by Russell. Being those rights of ways described reference in Deed Book No. 279, at Page 491, Will Book No. 24, at Page 62, and in Deed Book No. 732, at Page 289.
At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 505 State Street, Fairmont, WV 26554.
AND BEING the same real estate which was conveyed to Bryce R. Bunner and Yolanda Lynn Bunner, by Deed dated July 31, 2025, from Joseph Dean Martinez and Nora Rodriguez Ruiz, and recorded in the Office of the Clerk of the County Commission of Marion County, West Virginia, in Deed Book 1392 at Page 855.
The above-described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.
The subject property will be sold in "AS IS" condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
TERMS: Ten percent (10%) of the purchase price as a deposit with the balance due and payable within 30 days of the day of sale.
