TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Trustee, by virtue of the authority vested in him by that certain Deed of Trust dated May 27, 2016, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed of Trust Book 3053, at Page 412, Melissa E. DeHaven did convey unto Richard A. Pill, Esq., Trustee, certain real property described in said Deed of Trust; and default having been made under the aforementioned Deed of Trust, and the undersigned Trustee having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at 400 West Stephen Street in Martinsburg, West Virginia, on

June 8, 2026, at 10:14 AM

The following described real estate, with its improvements, easements and appurtenances thereunto belonging, situate in the Martinsburg District, Berkeley County, West Virginia, and more particularly described as follows:

All of that certain lot or parcel of real estate, with the improvements thereon and the appurtenances thereunto belonging, situate, lying and being in Martinsburg District, Berkeley County, West Virginia, and more particularly described as follows:

Lot No. 6, Phase III, Section 1, Prentiss Point Subdivision, as shown on that “Final Plat Showing Prentiss Point Subdivision, Phase III Section 1 Townhouse Lots 1-46 & 94-103 Lands of Dan Ryan Builders, Inc.” by Dewberry & Davis LLC, recorded in the Office of the Clerk of the County Council of Berkeley County, West Virginia, in Plat Cabinet 12, Slide 141.

SUBJECT TO and TOGETHER WITH the following: all covenants, restrictions, conditions, easements, reservations, rights-of-way, public utility easements, and other matters of record or in existence, to the extent valid, subsisting, and enforceable, including but not limited to those plat matters of record in the aforementioned Clerk’s Office in Plat Cabinet 12, at Slide 141, and those covenants, conditions, and restrictions of record in the aforementioned Clerk’s Office in Deed Book 839, at Page 50; any lien of taxes for the current year and subsequent years, accrued but not yet payable; matters that would be shown by an accurate survey and inspection of the property; zoning requirements, statutes, rules, orders, restrictions, regulations, and ordinances of governmental agencies or their instrumentalities relating to the property, the buildings located thereon, their construction and uses, in force on the date hereof (if any such exist); and, all roads and legal highways.

At the time of the execution of the Deed of Trust, this property was reported to have a mailing address of 111 Aero Street, Martinsburg, WV 25401.

AND BEING the same real estate which was conveyed to Melissa E. DeHaven, by deed dated December 22, 2015, from Robert J. Buchanan and Joanne Buchanan, and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Deed Book 1124 at Page 626.

The above described property will be sold subject to any covenants, restrictions, easements, leases and conditions of record, and subject to any unpaid real estate taxes.

The subject property will be sold in “AS IS” condition. The Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: Ten percent (10%) of the purchase price as a cash deposit with the balance due and payable within 30 days of the day of sale.
