Notice is hereby given that NICHOLAS CONTURA, LLC, PO BOX 457, 370 Packsville/Marfork ROAD, WHITESVILLE, WV 25209 has a permit on file with the Department of Environmental Protection (DEP) for the surface mining of approximately 443.44 acres and has submitted an application to the DEP, 1159 Nick Rahall Greenway, Fayetteville, WV, 25840, for renewal of Article 3 Permit Number S300105 to Maintain and operate a Coal Surface Mine (S300105-Bishop Surface Mine) in the Coalburg, Upper Winifrede, Middle Winifrede, Lower Winifrede, Chilton, Hernshaw, Williamson, Cedar Grove, Alma, Peerless, No. 2 Gas, Campbells Creek and Powellton seam of coal.
The operation is discharging into Town Creek, unnamed tributaries (locally known as Bee Branch and Georges Branch) of Willis Branch all of Paint Creek; unnamed tributary (locally known as Reeds Branch) and Ewing Fork of Toney Fork of Clear Fork of Big Coal River of Coal River of Kanawha River and is located 2.1 miles, northwest of Pax in Plateau and Clear Fork Districts of Fayette and Raleigh Counties, Longitude 81° 17' 59" and Latitude 37° 55' 18" (Coordinates from USGS Topographic Map).
