PUBLIC HEARING NOTICE

In accordance with Chapter 8A, Article 5, Section 8 of the Code of West Virginia 2004, as amended, the Berkeley County Planning Commission will hold a public hearing to consider the public comments on the following projects:

REQUEST FOR CONSIDERATION:

Mills Meadows: The property is located on Near Bethels Way, approximately half a mile northeast from its intersection with Nadenbousch Lane (WV Rt. 34), in the Arden Tax District. The developer is requesting an extension of the expired Preliminary Plan to allow the submission of a Major Plan Change and bring the project into compliance with the 2025 Subdivision and Land Development Ordinance. File# 2605-267

REQUEST FOR EXTENSION: PLK – Inwood: The site is located at the intersection of Winchester Avenue (US Rt. 11) and Gerrardstown Road (WV Rt. 51), at the northeastern corner of Terroso Way and Levardi Way, within Butler’s Crossing Commercial., in the Mill Creek Tax District. The developer is requesting a two-year extension of the approved Preliminary Plan, with a new expiration date of July 17, 2028. File# 2605-278 tied to 2301-024

REQUEST FOR WAIVER: Showe Family Transfer: The site is located at 462 Anderson Road approximately half a mile east of its intersection with Davis Drive, within the Hensell Heights subdivision, in the Falling Waters Tax District. The developer is requesting a waiver to Section 302.1.D.1, of the Subdivision and Land Use Ordinance (2025), requiring a 50′ right-of-way from the proposed family transfer lot(s) to a WVDOH right-of-way. The developer is also requesting a waiver to Section 505.4.c prohibiting more than one lot be situated between the main body of the panhandle lot and the access roadway. REQUEST FOR WAIVER: Sheetz #425 – Spring Mills: The site is located at 5715 Hammonds Mill Road (WV 901) at the intersection of Hammonds Mill Road (WV 901) and Williamsport Pike (US Rt. 11)., in the Falling Waters Tax District. The developer is requesting a waiver to Section 504, Table 5-2, of the 2025 Subdivision and Land Development Ordinance, which requires a 50′ setback for all sides abutting a WVDOH road File# 2606-316

The PUBLIC HEARING will be held on Monday, July 6, 2026, in the County Commission Chambers, 400 West Stephen Street, in the City of Martinsburg at 6:00 p.m. All persons and agencies having an interest on said plats are invited to participate in this hearing and make their comments known.

In the event that an unforeseen circumstance would cause the Planning Commission to cancel the scheduled meeting, a back-up public hearing date Monday, July 20, 2026 will be utilized.
