TRUSTEE’S SALE OF VALUABLE REAL ESTATE

The undersigned Substitute Trustee, by virtue of the authority vested in him by that certain Deed of Trust, dated June 29, 2018, and duly recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia, in Document No. 20180024722, in Book No. 3276, at Page 411 and modified by Loan Modification Agreement recorded on May 12, 2022 in Document No. 202200019289 MOD, in Book No. 3901, at Page 667, Diana M Mattice did convey unto Richard A. Pill, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by PennyMac Loan Services, LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Berkeley County Courthouse in Martinsburg, West Virginia, on

the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in 04 – Hedgesville District, Berkeley County, West Virginia, and more particularly described as follows:

All the following described real estate, with the improvements and appurtenances thereunto belonging, situate in the Hedgesville District, Berkeley County, West Virginia, being more particularly described as follows, to-wit:

Lot No. 47, Section II, Phase 1, Townhomes of Laurel Ridge, in Laurel Ridge Subdivision, containing 1600 square feet, more or less, as shown on that certain plat, dated May 25, 2000, prepared by Davis, Renn & Associates, Inc., and recorded in the Office of the Clerk of the County Commission of Berkeley County, West Virginia in Plat Cabinet No. 8, at Slide 128. TOGETHER WITH the right to the use of the common areas as shown on said plat and to the right to traverse the streets and roads of said subdivision in common with other “Townhomes of Laurel Ridge and Laurel Ridge Subdivision lot owners for the purpose of ingress and egress to and from said real estate.

AND BEING the same parcel of real estate conveyed to Diana Mildred Mattice by deed dated 29th day of June 2018, from Russell J. Munyan and Carmen S. Munyan, his wife, and recorded in the office of the Clerk of the County Commission of Berkeley County, West Virginia, immediately preceding this instrument.

FOR PURPOSES OF SECTION 4, ARTICLE I, CHAPTER 38 OF THE CODE OF WEST VIRGINIA, ANY NOTICE OF TRUSTEE’S SALE SHALL BE MAILED TO THE GRANTORS HEREUNDER AT THE FOLLOWING ADDRESS (OR SUCH OTHER ADDRESS SUBSEQUENTLY GIVEN TO LENDER IN WRITING BY THE GRANTOR): 16 Quince Tree Drive, Martinsburg, WV 25403

This conveyance is made subject to and together with any other covenants, conditions, agreements, easements, rights, rights-of-way and/or restrictions of record and in existence including but not limited to those covenants, conditions, agreements, easements, rights, right-of-way and restrictions recorded in Deed Book 521, at Page 103, Deed Book 575 at Page 486, Deed Book 609 at Page 161 and in Deed Book 650, at Page 558, and those matters set forth in Plat Cabinet 8, Slide 128.

At the time of the execution of the Deed of Trust, this property was reported to have an address of: 16 Quince Tree Dr, Martinsburg, WV 25403.

The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes.

The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.

TERMS: $9000.00 in cash and/or certified funds as deposit at the time of sale with the balance due and payable within 30 days of the day of sale. Sale is also subject to buyer providing Trustee with information needed for reporting requirements required by Federal Law including FinCen requirements (31 CFR Chapter X) within 15 days from date of sale.

FEDERAL TAX LIEN: In the event that there are Federal Tax Liens against the property, the United States would have the right to redeem the property within a period of 120 days from the date of such sale or the period allowable for redemption under local law, whichever is longer.

Pursuant to the Deed of Trust, the Trustee may postpone the sale by public announcement at the time and place designated or by posting a notice of the same, and act by agent in the execution of the sale. The parties secured by the Deed of Trust reserve the right to purchase the property at such sale.
