Michael, Trustee, certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated September 3, 2015 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by Ditech Financial LLC to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse in Beckley, West Virginia, on February 18, 2016 at 12:15 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Beckley District, Raleigh County, West Virginia, and more particularly described as follows: All that certain parcel of land situate in the Town District, County of Raleigh and State of West Virginia, being known and designated as follows: Beginning at a stake on Crescent Road, common corner of Lots 35 and 36; thence with the line of said Lots N. 0 deg. 33 min. West, 592.43 feet to a stake; thence N. 82 deg. 29 min. East, 100. 75 feet to a stake, common corner of Lots 34 and 35; thence with the line of said lots S. 0 deg. 33 min. East, 604.64 feet to a stake on Crescent Road; thence with the line of said road, S. 89 deg. 27 min. West, 100 feet to the place of beginning, containing 1.37 acres, more or less. And being more particularly bounded and described by a more recent survey as follows: A tract or parcel of land being Lot 35 of “Revised Map of Fairview Truck Farms” situated in the City of Beckley, and being more particularly described as follows: Beginning at a 1-inch steel pin found on the northern right of way line of Crescent Road, said rebar being a common corner between Lots 36 and 35; thence leaving said right of way line and with the common line between Lots 36 and 35, N. 00 deg. 33 min. West, 591.53 feet to a 1/2 inch rebar, set on the line of Homeseekers Land and Building Company; thence leaving Lot 36 and with the common line between said Homeseekers Land and Building Company and Lot 35, N. 82 deg. 29 min. East, 100.74 feet to a 1/2 inch rebar, set, said rebar being a common corner between Lots 35 and 34; thence leaving said Homeseekers Land and Building Company and with the common line between Lots 35 and 34, S. 00 deg. 33 min. East, 603.75 feet to a 1/2 inch rebar, set on the previously mentioned right of way line of Crescent Road; thence leaving Lot 34 and with said right of way line S. 89 deg. 27 min. West, 100 feet to the point of beginning, containing 1.372 acres, more or less, as surveyed by Eastern Surveying, Inc. in April, 1995 and shown on a plat attached hereto and made a part of this description. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 404 Crescent Road, Beckley, WV 25801. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed). The purchasers shall be responsible for payment of all real estate taxes. The subject property will be sold in “AS IS” condition. The Substitute Trustee shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property.
