TRUSTEES’ SALE OF VALUABLE REAL ESTATE The undersigned Trustees, by virtue of the authority vested in them by that certain deed of trust dated August 26, 2010, and duly recorded in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed of Trust Book 5040, at page 7871, Candice Settle and Derek P. Settle did convey unto National Real Estate, Trustee, certain real property described in said deed of trust; and the beneficiary has elected to appoint Terra Abstract Trustee West Virginia, Inc. as substitute Trustees by a Substitution of Trustee recorded in the aforesaid Clerk’s Office; and default having been made under the aforementioned deed of trust and the undersigned Trustees, having been instructed by the secured party to foreclose thereunder, will offer for sale at public auction at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia 25801 on: March 2, 2016 at 11:00 a.m. That certain tract or parcel of land situate in the City of Beckley, Raleigh County, West Virginia, and being more particularly bounded and described as follows: Tract No.1 Beginning at a stake at the back southwest corner of Lot No. 86 as shown on said Map No. 3 of the Woodland Hills Addition; thence N. 16 degrees 03′ W. 100 feet to a stake; thence N. 73 degrees 57′ E. 13.12 feet to a stake on line of Lot Nos. 11 and 12 of the said Garden Farms Addition; thence with a common dividing line of said Lots S. 66 degrees 56′ E. 158.53 feet to a stake on line of said Lot No. 86 of Woodland Hills Addition; thence with line of said Lot S. 73 degrees 57′ W. 135.51 feet to the point of beginning, containing 0.16 acres more or less. Also a two foot strip of land lying between Lilly Drive of Woodland Hills Addition as shown on Map No. 3 of said addition, recorded in the County Court Clerk’s Office of Raleigh County, West Virginia, in Map Book No. 11 at page 2, and the back end of Lot Nos. 10 and 11 and part of Lot 9 of the Garden Farms Addition. Said two foot strip of land is designated as “2′ Reservation” on map and extends from line of Lot 86 to the corner of Lot 70; a distance of approximately 185, as shown on said map of Woodland Hills. There is excepted and reserved from this conveyance that certain parcel conveyed by Deed dated June 25, 1974 from Alma M. Stevenson and Clifford A. Stevenson, her husband, to Summit Clyde Byrd and Nancy Katherine, the said Deed being recorded in Deed Book 537 at page 743. Tract No. 2 Beginning at a stake on Lilly Drive and being the common front corner of Lot Nos. 86 and 87 of said Woodland Hills; thence with the common dividing line of said Lot S. 73 degrees 57′ W. 154.89 feet to a stake on the dividing line of Lot Nos. 13 and 14 of the Garden Farms Addition, as shown on a map of the said addition recorded in said Clerk’s Office in Map Book No. 7 at Page 62; thence with said line N. 66 degrees 56′ W. 27.20 feet; thence N. 16 degrees 03′ W. 82.84 feet; thence N. 73 degrees 57′ E. 135.51 feet to a stake on the dividing line of Lot Nos. 11 and 12 of said Garden Farms Addition; thence with said dividing line S. 66 degrees 56′ E. 24.95 feet to a stake being the common back corner of Lot Nos. 11 and 12; thence with the back line of said Lot No. 11 N. 23 degrees 27′ E. 20.40 feet to a stake; thence N. 73 degrees 57′ E. 7.16 feet to a stake on said Lilly Drive; thence with said drive S. 16 degrees 03′ E. 100 feet to the point of beginning. Tract No. 3 Beginning at corner 1 on southerly line of Lot 11B in Garden Farms Addition in City of Beckley, W. VA.; being a corner of Lot 12 in said addition (situated S. 63 degrees 09′ E. for 16.52 feet from southwesterly corner of Lot 11B), thence with original division line of Lot 11B and Lot 12 S. 63 degrees 09′ E. at 158.53 feet passing through easterly corner of Lot 12 a point on the northerly line of Lot 86 in Woodland Hills Addition (situated N. 63 degrees 09′ W. 24.95 feet from a northerly corner of Lot 86) running 183.48 to said northerly corner, said corner (2) being original southeast corner of 11B, thence with original easterly line of 11B and 86, N. 27 degrees 14′ E. at 20.4 feet passing through another northerly corner of Lot 86, running 24.18 feet to corner (3), being revised southeasterly corner of Lot 11B on original westerly line of Lilly Drive, 35.0 feet wide (situated N. 70 degrees 39′ W. for 5.58 feet from northeasterly corner of Lot 86 on westerly line of Lilly Drive, 50.0 feet wide thence with revised southerly line of Lot 11B and revised northerly line of Lot 12 N. 70 degrees 39′ W. for 185.23 feet to place of beginning, containing 0.05 acres, more or less. Being the same property conveyed from Jeff D. Lilly to Derek P. Settle by Deed dated 02/27/2009, recorded 03/02/2009 in Book 5034, page 7379 of Raleigh, West Virginia. Tax Map or Parcel ID No.: 60-85, Tax Map or Parcel ID No.: 61-43.2, Tax Map or Parcel ID No.:60-85.1 Address: 527 N Lilly Drive Beckley, WV 25801. 527 North Lilly Drive Beckley, WV 25801 The aforesaid property is SUBJECT TO any and all easements, rights-of-way, conditions, covenants and restrictions of record or in existence. The sale of the foregoing real property will be made subject to all exceptions, reservations, rights of way, easements, conditions, covenants, restrictions, leases and other servitudes of record, if any, pertaining to said real estate, subject to all matters disclosed by an examination and inspection of the property, subject to any and all unpaid taxes as recorded against said property, and to any further matters announced at said sale. The property is sold subject to an accurate survey at purchaser’s expense. The sale of the foregoing real property will also be made expressly subject to any and all other deeds of trust, judgments, liens, and all other encumbrances of any nature whatsoever, if any, having priority over the deed of trust referred to herein.
