NOTICE OF TRUSTEE’S SALE Notice is given by the undersigned Trustee, in accordance with the provisions of the deed of trust made by The Tractor Company, Inc., a West Virginia corporation, to W.A. Thornhill, III and James F. Vaughan, Jr., Trustees, dated September 22, 2003, of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Microfilm Roll 5010, page 6857, securing a note in the original principal amount of $103,000.00 payable to the order of United Bank, Inc., a West Virginia banking corporation. United Bank, Inc., a West Virginia banking corporation, substituted Carl D. Andrews, as Trustee, by Substitution of Trustee dated April 4, 2016, of record in said Clerk’s Office in Microfilm Roll 5061, page 8470. The said The Tractor Company, Inc. has defaulted under the said Deed of Trust and, in accordance with the written request by United Bank, Inc., the holder and owner of the indebtedness secured by said Deed of Trust, the undersigned Substituted Trustee, or by his duly authorized agent, will sell at public auction on the 12th day of May, 2016 at 11:00 a.m. at the front door of the Raleigh County Courthouse, fronting on Main Street of the Courthouse of Raleigh County, Beckley, West Virginia, the following described property situate in Shady Spring District, Raleigh County, West Virginia, as more particularly described on the attached Exhibit “A”. EXHIBIT A All that certain tract or parcel of land, together with the improvements thereon and the appurtenances thereunto belonging, situate in Shady Spring District, Raleigh County, West Virginia and being Lot 19, Block 14, Paddocks Subdivision, Glade Springs Village, as set out on Tax Map 19E, Parcel 4.4, as shown upon a recorded map of Paddocks Subdivision of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Map File 4, at slide 274; and further being the same property conveyed to The Tractor Company, Inc. by Cooper Land Development, Inc. by deed dated September 18, 2003 of record in the aforesaid Clerk’s Office on Microfilm Roll 5010, page 6858. TERMS OF SALE: Said property will be sold for cash in hand on the date of sale by auction to the highest bidder. The sale shall be further subject to the following: (1) Real estate taxes delinquent, due or payable or to become due and payable. (2) Any statutory lien or liens that may affect the property. (3) All covenants, conditions, restrictions, reservations, easements and rights of way of record in the chain of title to the property, or as may be visible by a physical inspection. (4) The above property will be sold “AS IS, WHERE IS” in its present condition and with all faults and defects, if any, without any warranty or representation expressed or implied. (5) The Said property will be sold by a deed containing special warranty. (6) The undersigned Trustee expressly reserves the right to reject any and all bids and may adjourn the sale from time to time without notice other than oral proclamation at the time and place appointed for the sale. Such adjournment may be for a period of time deemed expedient by the beneficial owner and shall not be construed to be a waiver to make said foreclosures.
