NOTICE OF SALE BY TRUSTEE UNDER DEED OF TRUST Pursuant to the authority granted in that certain deed of trust dated February 14, 2000 from Chad M. Lilly to James F. Vaughan, Jr., W. A. Thornhill, III and Margot Bower, trustees to secure United Bank, Inc. and recorded in the office of the Clerk of the County Commission, Raleigh County West Virginia at Book 5001, page 8086, default having been made by the said Chad M. Lilly in the payment of the obligation secured by said Deed of Trust and having been requested in writing by the holder of the obligation secured, the undersigned will offer for sale at the front door of the Raleigh County Courthouse, 215 Main Street, Beckley, West Virginia, at 10:00 a.m. on Wednesday, June 8, 2016, that certain real estate conveyed by said deed of trust and more particularly described as follows: The surface of the two (2) following described tracts of land, together with any appurtenances thereunto belonging, located in the City of Beckley, Raleigh County, West Virginia, and being more particularly described as follows: The surface of those certain lots or parcels of land situate in the City of Beckley, Raleigh County, West Virginia, and being Lot No. 27 and Part of Lot No. 28, Section 38, of the McCreery Court Addition as shown and designated on a map entitled “McCreery Court Addition to the City of Beckley, W.Va., Scale 1″ = 200′, S. T. Farley C & ME and B. B. Gunnoe CE Beckley, W.Va.” which said map is of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 63, at page 338, to which said map reference is here made and made a part hereof for a more particular description of said Lot No. 27 and Part of Lot No. 28 and which said property herein conveyed is more particularly bounded and described as follows: BEGINNING at a stake on the southern right of way line of Clyde Street, a common corner of Lot Nos. 26 and 27 of Section 38 of the McCreery Court Addition; thence with said right of way line S 64 f 00′ E. 62.04 feet to a stake on said right of way line, a common corner of the tract herein conveyed and that certain tract conveyed to George A. Thornley and wife by deed dated June 10, 1972, and of record in said Clerk’s office; thence with the common boundary line between said tracts, S 25 f 13′ W 150.06 feet to a stake on the northern line of a 12-foot alley; thence with said line of said alley N 64 f 00′ W 66.4 feet to a stake, a common corner of said Lots Nos. 26 and 27; thence with the common boundary line between said Lots N 26 f 53′ E 150 feet to the place of beginning, and being Lot No. 27 and Part of Lot No. 28 of Section 38 of the McCreery Court Addition. And being the same property conveyed to Chad M. Lilly by deed from Bank of Raleigh, a corporation, dated August 14, 1992, and of record in the office of the Clerk of the County Commission of Raleigh County, West Virginia in Roll 28, at page 72. Under the provision of said deed of trust, the beneficial holder reserved the right to appoint a substitute trustee and the beneficial holder, United Bank, Inc., exercised said power by Appointment of Substitute Trustee dated the 26th day of April, 2016, and of record in the aforesaid Clerk’s office at Roll 5061, Page 9749, appointing the undersigned substitute trustee in the place and stead of the said James F. Vaughan, Jr., W. A. Thornhill, III and Margot Bower, Trustees. The above described property will be conveyed by the undersigned to the purchaser by deed without warranty of any kind, express or implied, and will be made subject to all property taxes, prior liens, including any liens for sewer services assessed by any municipality or public service district, reservations, encumbrances, restrictions, rights of way, easements, covenants, charges and conditions of record in the aforesaid Clerk’s Office affecting the subject property. The subject property will be sold in “AS IS” condition. The undersigned shall be under no duty to cause any existing tenant or person occupying the subject property to vacate said property. TERMS OF SALE Cash in hand on day of sale. The above described real estate will be sold by auction to the highest bidder, subject to the right of the undersigned to reject any and all bids if, in his opinion, it is or they are inadequate. The owner of the indebtedness secured by the above described deed of trust and the owner of any other interest in the property to be sold shall have a right to bid. CONTINUANCE – ADJOURNMENT OF SALE The undersigned reserves the right to continue the sale, or to adjourn the sale, for a time, or from time to time without further notice than announcement at the time and place of sale as hereinabove set forth or any continuance or adjournment thereof.
