ORDER OF PUBLICATION Please take notice that on July 27, 2016 at 1:00 p.m. a hearing has been scheduled before the Honorable Robert A. Burnside, Jr. on plaintiff’s complaint for a Partition Or In The Alternative To Quiet Title to Real Estate, and based upon plaintiff’s affidavit that this matter involves real estate inherited through heirship partially by the plaintiff, and that no one is plaintiff’s family has heard from Constance Osborne since 1980 or prior thereto, and no one has any information whatsoever regarding her current whereabouts, that the Court make such rulings as deemed appropriate regarding the fractional interest owned by the defendant, Constance Osborne, in two parcels of real estate situate in Lilly Town Addition, Town District, Raleigh County, West Virginia, and being bounded and more particularly described as follows: TRACT NO. ONE: Being a part of the surface of Lot No. 19 of said addition as shown on a map of Lilly Town Addition of record in the Office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book 279, at page 107, and the part of said Lot No. 19 herein conveyed is more completely described as follows: BEGINNING at an iron pin a common corner to Lots 8 and 9; thence No. 6 f 45′ W. 63.98 feet to an iron pin; thence N. 32 f 03′ W. approximately 48 feet to an iron pin; thence at right angles to this line through Lot No. 19 a distance of approximately 48 feet to an iron pin on East Avenue; thence S. 44 f 17′ E. with East Avenue and Lot 8 a distance of 92.88 feet to the iron pin, the place of beginning. TRACT NO. TWO: The surface of Lot No. Eight (8) of LILLY TOWN, in Town District, Raleigh County, West Virginia, as shown by a map thereof recorded in the office of the Clerk of the County Commission of Raleigh County, West Virginia, in Deed Book No. 279, at page 108, as a part of a deed recorded therein Deed Book No. 279, Page 107, to which reference is here made. Said lot fronts 162.2 on East Avenue, and extends back therefrom with Lot 19 a distance of 42.88 feet, and back on opposite side with Lot 7 a distance of 119.2 feet, being 194.38 feet wide at rear. See map for better description. And being the same property devised to Martha Lucille Harold by the Last Will and Testament of her husband, Avery Warren Harold, which Will is of record in the Office of the Clerk of County Commission of Raleigh County, West Virginia in Will Book 5006, at page 3588; the aforesaid Avery Warren Harold having acquired the subject property by deed dated the 3rd day of June, 1977, from Kenneth R. Osborne and Tok Sun Osborne, his wife, as Warren Harold, which is of record in the aforesaid Clerk’s Office in Deed Book 581, at Page 595, said deed conveying a one-half (1/2) undivided interest only; the other one-half (1/2) undivided interest having been devised to Martha Lucille Harold by the Will of her mother Pauley June Osborne, who died testate on April 5, 1988, said Will being of record in the aforesaid Clerk’s Office in Will Book 42, at page 825. Upon information and belief, Plaintiff / Affiant states that the interest of Constance Osborne is approximately 4/16 of 1{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c} of the subject property, and therefore being of minimal value to either be forfeited to plaintiff by default, or in the alternative that plaintiff be allowed to pay into the general receiver for the Court the value of defendant’s interest determined by the Court, and that a Special Commissioner be appointed to convey said interest to the plaintiff in the matter, and that you have a right to appear at said hearing and protect her interest should you so desire.
