There will be a second reading and public hearing on the following ordinance on July 12, 2016 at 6:30 p.m. in the Common Council Chambers at Beckley City Hall. This ordinance will be available for review at Beckley City Hall, 409 South Kanawha Street between the hours of 8:30 a.m. and 4:30 p.m., Monday – Friday. AN ORDINANCE TO SELL A LOT LOCATED AT CORNER OF HOWE STREET AND SOUTH FAYETTE STREET WHEREAS, the City of Beckley is the owner of a lot located on the corner of Howe Street and South Fayette Street, currently used for monthly parking, which lot was purchased from Edward M. Payne, III et.al. on March 1, 2008 ; and WHEREAS, the lot is underutilized as a parking lot and is being used for no other public purpose; and WHEREAS, Jan Care Ambulance (Cornett Properties, Inc.) is located on property adjacent to this lot and, because of its need and desire to expand its operation, has requested the City of Beckley to sell this lot to it for fair and adequate consideration; and WHEREAS, the City of Beckley is desirous of selling this lot to Cornett Properties, Inc. for the benefit of Jan Care Ambulance for fair and adequate consideration; and WHEREAS, Robert G. Wilson, Jr., a West Virginia Certified Residential Real Estate Appraiser has appraised this lot and determined the “as is” market value of this lot is seventy-seven thousand dollars ($77,000.00); and WHEREAS, the City of Beckley, pursuant to authority granted by the West Virginia Home Rule Board, has previously adopted an Ordinance permitting it to “?.sell real and personal property for fair and adequate consideration to private purchasers without action in such a manner that promotes economic development or provides a service for public goods.” NOW, THEREFORE, BE IT ORDAINED BY THE COMMON COUNCIL OF THE CITY OF BECKLEY that pursuant to West Virginia Code Sections 8-11-3 and 8-12-18, and pursuant to the Ordinance authorized by the West Virginia Home Rule Board adopted by this Common Council on December 8, 2015, the Mayor and Recorder Treasurer are hereby authorized to sell the lot as described in Exhibit A and located at the corner of Howe Street and South Fayette Street in Beckley, West Virginia for fair and adequate consideration said sum being seventy-seven thousand dollars ($77,000.00) to Cornett Properties, Inc. (Jan Care Ambulance.) “EXHIBIT A” (Property Description) The lot belonging to the City of Beckley located on the corner of Howe Street and South Fayette Street as shown on Tax Map 19, as Parcel No. 0004 on the land books for the City of Beckley, Raleigh County, West Virginia, and being more particularly described as follows: BEGINNING at a point in the eastern right of way line of South Fayette Street at its point of intersection with the northern right of way line of Howe Street; thence following the said eastern right of way line of South Fayette Street, N. 22 f 26′ W. 71.50 feet to a point, said point being a common corner between Alma M. Payne and Loyal Order of Moose; thence following the property boundary line between said Alma M. Payne and Loyal Order of Moose, the following courses and distances, namely: (1) N. 61 f 22′ E. 85.27 feet and (2) N. 22 f 26′ W. 26.00 feet and (3) N. 64 f 05′ E. 4.90 feet to a point, said point being a common corner between said Loyal Order of Moose and May Building Company, Inc., and being also a point in the said property boundary line of Alma M.
