Edelman did convey unto Bailey & Slotnick, PLLC, Trustee(s), certain real property described in said Deed of Trust; and the beneficiary has elected to appoint Seneca Trustees, Inc., as Substitute Trustee by a Substitution of Trustee dated June 13, 2016 and recorded in the aforesaid Clerk’s office; and default having been made under the aforementioned Deed of Trust, and the undersigned Substitute Trustee having been instructed by JPMorgan Chase Bank, National Association to foreclose thereunder, will offer for sale at public auction at the front door of the Fayette County Courthouse in Fayetteville, West Virginia, on August 10, 2016 at 4:00 p.m. the following described real estate, together with its improvements, easements and appurtenances thereunto belonging, situate in Smithers District, Fayette County, West Virginia, and more particularly described as follows: In the Town of Smithers, Fayette County, West Virginia, and being more particularly bounded and described as follows, to-wit: TRACT NO. 1: ALL OF LOT NO. 26 AND PART OF LOT NO. 27 SECTION “C”, OF THE OAKLAND SUBDIVISION TOWN OF SMITHERS, as shown on a map or plat thereof, marked “Oakland Subdivision to Smithers, Fayette County, West Virginia,” and recorded in the Office the Clerk of the County Court of Fayette County, West Virginia, together with all improvements thereon and appurtenances thereunto being and bounded and described as follows, to-wit: Beginning at an iron pin at the intersection of Birch Street and Kanawha Avenue, thence with Birch Street N 83 f 07 E 95 feet, to a pin in the line of a twelve foot alley. Thence with said alley, S 6 f 53 E 60.0 to a pin, thence S 83 f 07 W 95.0 to a pin in the line of Kanawha Avenue, thence with said avenue N 6 f 53 W 60.0 feet to the beginning, containing 5,700 feet. TRACT NO. 2: Beginning with a corner at the wall, which bears S 6 f 53 E 60 feet along the alley line from Birch Street. Thence with said alley line S 6 f53 E 30 feet to pin. Thence with the original line between Lot 27 and 28 S 83 f 07 W 95 feet to a mark on the edge of sidewalk. Thence N 6 f 53 W 30 feet to a point on edge of sidewalk, said point being 60 feet from Birch Street. At the time of the execution of the Deed of Trust, this property was reported to have an address of: 391 Kanawha Avenue, Smithers, WV 25186. The referenced real estate will be conveyed with no covenants of warranty, and subject to all covenants, restrictions, easements, rights of way and reservations which may be a matter of record in the aforesaid Clerk’s Office or visible upon the ground, all prior liens and encumbrances, including, without limitation, liens for real estate taxes, incinerator, sanitary and sewer charges. The purchasers at the sale shall be responsible for paying the recording costs and also the tax on the privilege of transferring real property (the cost of the tax stamp to be affixed to the deed).
