PUBLIC NOTICE OF VOLUNTARY REMEDIATION AND REDEVELOPMENT ACT for Public Meeting

Select Energy Services, LLC (SES Assets, LLC), 1400 Post Oak Boulevard, Suite 400, Houston, TX 77056 and Affirm Oilfield Services, 3575 Lone Star Circle, Suite 410, Fort Worth, TX 76177 has entered into a Voluntary Remediation Agreement with the West Virginia Department of Environmental Protection (WVDEP) for its facility located along the Ohio River, Buckstone LLC Belmont VRP #11442, located at 8598 S. Pleasants Highway, St. Mary’s, West Virginia (the Site). The Site is currently entered into the Voluntary Remediation Program (VRP). This Voluntary Remediation Agreement includes investigations and reporting performed under VRP #11442 on the 47-acre Site. The VRP investigations addressed surface soil, subsurface soil and groundwater.
This publication is to notify the public of the 30-day comment period regarding the development of soil remediation goals for a small portion (approximately 150 feet by 200 feet) of the Site that exceeds an excess lifetime cancer risk of 1×10-5 for non-residential properties for arsenic exposure. Interested persons may review pertinent site information at the public repository located at the Pleasants County Public Library, 101 Lafayette Street, St. Mary’s, WV 26170 established for the site or at the WVDEP Office of the Division of Land Restoration, 601 57th Street, SE, Charleston, West Virginia, 25304, (304) 926-0499.
The site is currently used as a bulk material storage facility (sand and gravel), and oilfield equipment storage facility. Historically, the site has been used for similar purposes. Future use of the site is anticipated to remain industrial.
Arsenic has been identified as a chemical of concern (COC) in soil in the southeastern portion of the Site. Sources of the arsenic in soil are likely the result of storing coal historically.
A human health risk assessment has been conducted to evaluate the potential for adverse human health effects that may result from exposure to COCs under current and planned future use. Based upon this assessment, arsenic in soil posed a significant risk to current and future on-Site workers.
Thus, a remedy selection process was implemented to address site risk. Soil containing arsenic concentrations exceeding the state of West Virginia industrial direct contact De Minimis standard (27 mg/Kg) will remain in place and be demarcated by signage. The estimated excess lifetime cancer risk for onsite outdoor industrial workers is 2.2×10-5 (or approximately 2 in 100,000) for residual arsenic concentrations. This risk is less than the maximum acceptable level for industrial sites (1×10-4 or 1 in 10,000). However, because the calculated risk exceeds 1×10-5 (1 in 100,000), a public notice and public meeting are required in accordance with the Voluntary Remediation and Redevelopment Rule, Œ60-3-7.12.
Institutional controls will also be used to manage human health risks at the site to achieve remedial action objectives and will include a Land Use Covenant (LUC) to be recorded in the Pleasants County Clerk’s Office. The intent of this LUC is to: a) prohibit the development or use of property for residential purposes; b) prohibit the disturbance or excavation of the soils in the demarcated (and surveyed) area without Licensed Remediation Specialist (LRS) oversight, and a soil management plan to protect construction workers in the event of future on-Site soil excavation (off-site disposal of any contaminated soil from the Site will be done only after adherence to federal and state regulations for solid waste management); and c) prohibit extraction of groundwater for any use except groundwater monitoring and/or remediation.
The public meeting will take place on March 21, 2017 at 6 p.m. at the Site, Buckstone LLC Belmont, located at 8598 S. Pleasants Highway, St. Mary’s, West Virginia.
