NOTICE OF TRUSTEE’S SALE

NOTICE IS HEREBY GIVEN that by virtue of that certain Deed of Trust dated March 15, 2011, executed by Oreta Gaye Lane to Debra L. Dalton, Trustee, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Trust Deed Book 1208, at page 141, and by Assignment of Deed of Trust and Note dated January 12, 2012, executed by Jay H. Lane to Bo Daniel Syres, of record in the Office of the Clerk of the County Commission of Mercer County, West Virginia, in Assignment Book 24, at page 373, David M. Kersey having been substituted as Trustee pursuant to Substitution of Trustee of record in the aforesaid Clerk’s office in Trust Deed Book 1348, at page 545, default having occurred in payment of the indebtedness secured by said deed of trust, and the undersigned substitute trustee having been requested to do so by Bo Daniel Syres, owner and holder of the indebtedness secured by said deed of trust, the undersigned substitute trustee will offer for sale and sell at public auction on April 24, 2018, at 10:00 a.m., at the north entrance to the Mercer County Courthouse, 1501 Main Street, Princeton, Mercer County, West Virginia, the following described real estate lying in the District of Beaver Pond, County of Mercer, State of West Virginia, situated on the headwaters of Brush Creek, and being the west one half of a boundary of 193/4 acres of land which was conveyed by Princeton Bank and Trust Company, a Corporation, to Ethel M. Belcher by deed of January 7, 1936, and therein described as two tracts of land, together with the improvements thereon and appurtenances thereunto belonging, more particularly bounded and described as follows:
FIRST TRACT: BEGINNING at a stone in a line of G. A. Hypes land near a branch; thence with said line N 88 W 65 poles to a beech and birch, corner to John Archer; thence with line of said Archer and A.B. Morgan’s land, S 25 E 72 poles to two dogwoods by a fence on a point in the line of said Morgan; thence with a fence down the point N 80 E 10 and 2/3 poles to a stone; N 38 E 17 poles to a chestnut and small hickory; N 46 E 19 and 2/3 poles to two chestnuts at the end of the point; thence N 2 E 281/2 poles to the BEGINNING, and containing 163/4 acres, more or less.

SECOND TRACT: BEGINNING at a dogwood on top of a ridge, corner to Cora Belcher place, in a line between said tract and the Belcher tract; thence with the said line to the top of the ridge to a hickory and white oak, corner to John Archer place; thence in a southern direction to a black jack on a north hillside; thence a southeast direction to a chestnut on top of a hill; thence with the top of the hill, with a blazed line to the BEGINNING, and containing three (3) acres, more or less.

BEING all and the same realty and improvements acquired by Oreta G. Lane and the late Jerry Lane, by deed dated September 4, 1984, from A. T. Belcher and Ethel M. Belcher, which is of record in the Mercer County Clerk’s Offices in Deed Book 636 at Page 566, Jerry Lee Lane having died on March 7, 2007, vesting sole title to said property to the said Oreta Gaye Lane by virtue of the survivorship provisions of said deed.

TERMS OF SALE: Ten percent (10{4ceb532c6f579389df471c6c1e832caf2346b74dc60fcbf6aabd4d29df3baf9c}) cash in hand on day of sale and balance upon delivery of deed. Sale subject to any and all real property taxes or assessments due or to become due, all applicable subdivision and zoning restrictions, matters of survey, compliance with environmental regulations, rights of tenants in possession, if any, and all other pertinent liens, easements, restrictions and reservations of record. The property is sold in an “as is” condition. The purchaser shall pay the excise tax on the transfer of real estate. Any personal property remaining on the premises at the time of sale shall be considered abandoned. The undersigned trustee reserves the right to reject any and all bids, the right to continue the sale by announcement on the date of the sale and the right to announce other conditions upon the sale, which announced conditions, if any, shall be in addition to or take priority over any conditions set forth herein.
